ضرورت و راهکارهای مشارکت بخش خصوصی در ارزیابی تأثیرات قانون در ایران (مقاله علمی وزارت علوم)

چکیده
هرگونه فرایند ارزیابی تأثیرات اقتصادی قانون، پیش از تصویب قانون، منوط به در اختیار داشتن برآوردی از «بار مقرراتی» آن، به معنای هزینه های تبعیت از قوانین و مقررات برای کسب وکارهاست. مشارکت در مقررات گذاری در قالب ارزیابی بار مقررات در برخی کشورهای توسعه یافته، توسط نهادهای نمایندگی کننده فعالان اقتصادی صورت می گیرد. پیشنهادی که در خصوص نحوه مشارکت فعالان اقتصادی در ارزیابی تأثیرات پیشینی اقتصادی قانون قابل ارائه است، ارزیابی بار مقررات لوایح و طرح ها توسط اتاق ایران با همکاری دیگر نهادهای نمایندگی کننده فعالان اقتصادی در قالب گزارش هایی است که طبق قانون باید به «شورای گفت وگوی دولت و بخش خصوصی» و «کمیته موضوع ماده 12 قانون احکام دائمی برنامه های توسعه کشور» («کمیته حمایت از کسب وکار») ارائه شوند. در واقع، شیوه عملی و در دسترس ارزیابی بار مقررات در ایران، نظرخواهی و نظرسنجی از فعالان اقتصادی، اصناف و تشکل ها درباره قوانین و مقررات و انعکاس هزینه های آنها به طور مستدل و مستند به مراجع مقررات گذار است.The Necessity of and the Mechanism for Private Sector Participation in Regulatory Impact Assessment in Iran
Any process of assessing the Regulatory Impact Assessment (RIA), ex ante to its approval, is subject to an estimate of its "regulatory burden", meaning the costs of complying with the laws and regulations for businesses. Participation in regulation in the form of regulatory burden assessment in some developed countries is done by institutions representing economic actors. A suggestion that can be made on how to involve economic actors in ex ante Regulatory Impact Assessment that the Iranian Chamber of Commerce, Industries, Mines & Agriculture, in cooperation with other representative bodies of economic actors, evaluate the burden of the draft in the form of reports to the Government-Private Sector Dialogue Council and "Committee of Article (12) ("Business Support Committee"). In fact, the practical and available method of assessing the burden of regulation in Iran is to survey economic actors, trade unions and organizations about laws and regulations and reflect their costs in a documentary manner to the regulatory authorities.
