چکیده
امروزه حقوق توسعه یکی از شاخه های اصلی از علم حقوق است که دستیابی بشر به خواسته های اساسی را تسهیل می کند و مورد توجه ملل مختلف است. برای دستیابی به توسعه نیاز به برنامه ریزی است که در قالب نظام برنامه ریزی صورت می گیرد. الگوهای مختلفی برای دستیابی به توسعه وجود دارد که دولت ها به عنوان اعمال کننده حاکمیت و اقتدار عمومی، بر مبنای ایدئولوژی، آرمان ها، اصول و اهداف کلان جامعه خود که در قانون اساسی و سایر اسناد بالادستی متجلی می شوند، با توجه به عنصر هدفمندی به برنامه ریزی توسعه می پردازند. این مقاله با استفاده از روش توصیفی- تحلیلی در پی تبیین جایگاه حقوقی برنامه ریزی توسعه در نظام حقوقی ایران است و به شناسایی الگوهای مختلف توسعه می پردازد و در نهایت به این پرسش پاسخ می دهد که نظام حقوقی جمهوری اسلامی ایران با کدام یک از الگوهای توسعه، منطبق است. یافته های این پژوهش، نشان می دهد، برنامه ریزی توسعه در ایران، با الگوهای اقتصادی رایج، منطبق نیست و در نهایت با تبیین نظام حقوقی برنامه ریزی توسعه در ایران، الگوی مناسب پیشنهاد می شود.Explaining the Status of Development Planning in the Legal System of the Islamic Republic of Iran
Development law is a branche of law that facilitates human achievement of basic needs and is of interest to various nations. Achieving development requires planning that takes place in the form of a planning system. There are various models for achieving development through which governments exercise sovereignty and public authority, based on the ideology, ideals, principles and goals of society. Based on the constitution and other upstream instruments, governments plan for development according to a purposeful element. Using a descriptive-analytical method, this paper seeks to explain the legal status of development planning in the Iranian legal system and identifies different patterns of development and finally answers the question which development modell matches the legal system of the Islamic Republic of Iran? The findings of this study show that development planning in Iran is not consistent with current economic models and by explaining the legal system of development planning in Iran, an appropriate model will be proposed.
