تحلیل زیاده و نقیصه روایات فقهی از منظر صاحب جواهر

چکیده
از اسباب تعارض در روایات معصومان(ع)، پدیده زیاده و نقیصه در متن احادیث است. برطرف کردن این آسیب جز با استفاده از تجربیات فقیهان و حدیث پژوهان خبره ممکن نیست کتاب بی نظیر جواهر الکلام فی شرح شرائع الاسلام می تواند در جهت آسیب زدایی از احادیث فقهی راهگشا باشد. نوشتار پیشرو با روش توصیفی-تحلیلی، درصدد است عوامل زیاده و نقیصه، قراین شناسایی آن، پیامدها و راه حل ها را از نظر صاحب جواهر بررسی کند. یافته ها نشان می دهد از نظر ایشان، راویان و ناسخان به عنوان عوامل، و گزارش خبرگان حدیث، سنجش روایت با احادیث هم مضمون، مراجعه به کتب اصیل روایی، اتحاد سند یا راوی و عدم وضوح معنا به عنوان قراین، و اضطراب، تأثیر نادرست بر فتوا، خروج از حجیت، شاذّ شدن روایت و ... به عنوان آثار این آسیب مطرح می شود و راه حل عبارت است از اضبط بودن، رجوع به کتب حدیث و استدلال، مراجعه به نسخه های مورد اعتماد، قرار گرفتن حدیث در باب مربوط و موافقت با عامه.An Analytical Survey of Perfection and Imperfection of Jurisprudential Hadiths from the Perspective of Al-Jawaher Compiler
The phenomenon of perfection and imperfection of text is a cause of conflict in the Hadiths of the Infallibles Imams (AS). It is not possible to avoid this defect except by using the knowledge of jurists and hadith experts. The remarkable book of Jawahar al-Kalam fi Sharh Sharia al-Islam could be a solution for defects of jurisprudential hadiths. The present paper, by a descriptive-analytical method, seeks to study the origin of perfection and imperfection, their identification, consequences and solutions in relation with Al-Jawaher. Findings show that, based on his view: the source of defect are the narrators and writers of hadiths; the signs and evidences are the report of hadith experts, comparing the similar hadiths, referring to the original sources of hadith, similarity of text and authority and the lack meaning clarity; and the defects are lack of order, the worse effect on the fatwa, authority missing, hadith oddness, and etc.; precise narration, referring to the books of hadith and reasoning, relying on the trusted versions, hadith occurrence in the relevant chapter and with Sunni hadith agreement are the sloutions.
