دوگانگی یا وحدت خیار رؤیت و تخلف از وصف با تاکید بر دیدگاه امام خمینی

چکیده
در فقه امامیه و حقوق ایران درخصوص وحدت یا دوگانگی خیار رویت و خیار تخلف از وصف اختلاف نظر وجود دارد. قانون مدنی نیز در این خصوص موضع روشنی اتخاذ نکرده و با ذکر این دو خیار در بند 5 ماده 396 باعث ایجاد این تصور شده که دو خیار مزبور حقیقت واحدی دارند. امام خمینی درکتاب تحریر الوسیله عنوان کلی خیار رویت را برای چهار مصداق استعمال کرده اند که سه مورد آن از مصادیق تخلف وصف است لکن در کتاب البیع صراحتا بیان داشته اند دو خیار مزبور دارای ماهیت جداگانه و منفک از هم می باشند، هرکدام از نظرات فوق طرفدارانی در میان اندیشمندان فقهی دارد. در این مقاله که به شیوه تحلیلی- توصیفی به رشته تحریر درآمده با بررسی دلائل ارائه شده توسط قائلین به دوگانگی و وحدت دو خیار، دیدگاه منتخب و مصرح حضرت امام در کتاب البیع، یعنی دوگانگی دو خیار مذکور، بر اساس مبانی موجود تقویت شده و مورد قبول قرار گرفته است. بر این اساس خیار تخلف وصف مربوط به زمانی است که کالا با توصیف در متن عقد مورد معامله قرار گیرد لکن زمانی که با وصف خارج از عقد یا تبانی طرفین بر وجود اوصاف قبل از عقد یا رویت سابق مبیع یا انجام عقد بر اساس جزئی از مبیع و قیاس باقی موضوع به همان جزء و مبتنی بر وجود صفت موجود در جزء، معامله صورت گیرد مصداق خیار رویت خواهد بود.The unity or duality of Vision option and Option of default description with an approach to the viewpoint of Imam Khomeini (RA)
Abstract: There is a different opinion in the jurisprudence of Imamiyeh and Iranian law regarding the unity or duality of Vision option and Option of default description. Civil law has not taken a clear position in this regard, and mentioned these two Options in clause 5 of Article 396 together. It has been assumed that two Options have a single nature.Imam Khomeini, in Tahrir Al-vasilah, used the general title of Vision option for some cases that seems to be examples for Option of default description, but in the Al-Bai he explicitly state that the two options are distinct and separate from each other. In this paper, which is descriptive-analytic, by examining the given reasons, the viewpoint of Imam Khomeini means independency of two options has been strengthened and accepted on the basis of existing foundations.Accordingly, Option of default description exists when the goods are traded by description in the contract, but when the transaction is carried out with the description outside of contract and its collusion or on the former sighting, the Vision option will be available.
