چکیده
قرارهای تأمین کیفری از جمله قرارهای موقت و اعدادی هستند؛ موقت هستند چون محدود کننده آزادی تا مشخص شدن نتیجه دادرسی در اصل دعوی می باشند و اعدادی هستند به این دلیل که مقدمات انجام تحقیقات و بازجویی و بررسی دلائل و مدارک طرفین و دادرسی جزایی منصفانه را فراهم می کننددر آیین دادرسی مدنی و کیفری، قرار تأمین، جهت جلوگیری از تضییع حقوق اصحاب دعواست و با از بین رفتن شرایط صدور قرار، منتفی می شود. به موجب این قانون قرار تأمین انواع مختلف دارد از جمله: بازداشت موقت، کفالت، وثیقه، تعهد که در این نوشتار به واکاوی فقهی قبول کفالت که به موجب آن یک نفر (کفیل) در مقابل طرف دیگر (مکفول له)، حضور شخص ثالثی (مکفول) را ضمانت می کند، پرداخته شد و از طریق جمع آوری کتابخانه ای منتج شد که اگر تضمین حقوق بزه دیده به طرق دیگر امکان پذیر باشد، مانعی برای صدور کفالت است و قبول مال معرفی شده توسط وثیقه گذار منوط به شرایط و امکانات دادسرا برای پذیرش آن است. وجه الکفاله و وثیقه نباید در هر حال از خسارت وارد به بزه دیده کمتر باشد.کلیدواژه ها: قرارتأمین، کفالت، متهم.Jurisprudential analysis of sponsorship
