چکیده
با توجه به افزایش و توسعه داوری بین المللی، سرمایه گذاران به منظور افزایش امکان پیروزی خود در دعوای مطروحه به طرق مختلف به سوءاستفاده از روش های شکلی رسیدگی می پردازند و بدین وسیله سبب تضعیف اعتبار داوری بین المللی به عنوان یکی از طرق مؤثر حل وفصل اختلاف های بین المللی می شوند، در سوءاستفاده از جریان رسیدگی در دعاوی سرمایه گذاری شخص سرمایه گذار حقوق خود را به طریقی که مغایر با هدف تأسیس آن حق است، اعمال می کند. انجام این امر اغلب توسط طرح دعاوی متعدد و جداگانه در مراجع متعدد حل وفصل اختلاف به طور موازی یا همزمان توسط شرکت های زنجیره ای سرمایه گذاری و شرکت های فرعی متعلق به شرکت اصلی یا سهامداران دارای تابعیت های متفاوت متعلق به یک شرکت زنجیره ای و در خصوص یک خواسته مشابه علیه دولت میزبان و به موجب معاهدات متعدد سرمایه گذاری انجام می گیرد. بنابراین دولت میزبان با طرح دعاوی متعدد از سوی سرمایه گذاران مواجه شده و ملزم به جبران خسارات مضاعف در خصوص یک خواسته مشابه خواهد شد. قاعده منع سوءاستفاده از جریان رسیدگی که نمادی دیگر از اصل کلی حسن نیت به عنوان یکی از اصول اساسی حقوق بین الملل و حقوق سرمایه گذاری بین المللی است، اغلب توسط دیوان داوری ایکسید در دعاوی مطروحه اعمال می شود.Abuse of Process in Investment Arbitrations
Due to the increase and development of international investment arbitrations, investors have abused procedural tactics to increase their chances of winning in these arbitration proceedings. This undermines the credibility of international arbitration as one of the effective means of resolving international disputes. Abuse of processes in investment arbitration takes place when an investor exercises his right in a way that is contrary to the aim and purpose of that right. It happens when chain companies and subsidiaries owned by a parent company or shareholders of a chain company with different nationalities seek the same relief against the host at different arbitral tribunals in parallel or simultaneous lawsuits. Therefore, the host state will face multiple claims from multiple investors and is required to pay multiple damages. The principle of abuse of process is an expression of the more general principle of good faith, a fundamental principle of international law, as well as investment law. So, ICSID tribunals will often invoke the principle of abuse of process in their cases.
