چکیده
جبران خسارت از مهم ترین ابزارهای عدالت کیفری در حقوق بین الملل است که در این مقاله از منظر فقه و حقوق کیفری مورد بررسی قرارگرفته است. مقاله پیش رو توصیفی تحلیلی بوده و با استفاده از روش کتابخانه ای به بررسی موضوع پرداخته است. یافته های مقاله بیانگر این امر است که به طورکلی حق جبران خسارت مؤثر، حق رفتار شدن بر اساس احترام و کرامت، حق حمایت و مساعدت و حق درخواست غرامت ازجمله حقوقی است که در اسناد بین المللی و منطقه ای برای قربانیان نقض های شدید حقوق بشر و حقوق بشردوستانه بین المللی به رسمیت شناخته شده است. حق جبران خسارت مؤثر شامل حق پیگرد و مجازات افرادی است که مسؤول نقض های گسترده حقوق بشری می باشند. البته جبران خسارت بزه دیده در حقوق کیفری بین المللی با چالش هایی مواجه است. وسعت خسارات و آسیب هایی وارده و نیز تعداد زیاد بزه دیدگان ازجمله این چالش ها است. عدم همکاری دولت ها، دشواری تعیین میزان خسارت و همچنین کمبود منابع مالی جبران خسارت از دیگر چالش ها در این زمینه است.Obligation to Compensate the Damage to a Victim in Jurisprudence and International Criminal Law
Damage compensation is one of the most important tools of criminal justice in international law, which is examined in the present paper from the perspective of jurisprudence and criminal law. This paper is descriptive and analytical and has investigated the mentioned subject employing the library method. The findings of the article show that, in general, the right to effective compensation, the right to be treated with respect and dignity, the right to support and assistance, and the right to request compensation are among the rights that are included in international and regional documents for victims of severe violations of human rights and international humanitarian law. The right to effective compensation includes the right to prosecute and punish people who are responsible for extensive violations of human rights. Indeed, compensating victims in international criminal law faces challenges. The extent of damages and injuries and the large number of victims are among these challenges. Non-cooperation of governments, difficulty in determining the amount of damage and lack of financial resources for compensation are other challenges in this field.
