چکیده
اداره و وضعیت صندوق های بازنشستگی، همواره از موضوعات اصلی و مورد دغدغه در تمامی جوامع است. این نهاد به لحاظ کارکردهای خود، از جایگاه بالا و اثرگذاری چندوجهی برخوردار است. وخامت وضعیت صندوق های بازنشستگی می تواند در ارکان جامعه و ساختار اقتصادی تأثیرات جدی بر جای بگذارد؛ وضعیت صندوق های بازنشستگی در اروپا، از مدت ها پیش زیر نظر بوده و مطالعات قانونگذاری در این حوزه توأم با آینده نگری و احتیاط است. مقامات مسئول دریافتند بی توجهی و غفلت می تواند بحران های مشروعیت و کارامدی را به صندوق ها تسری دهد؛ ازاین رو اصلاحات مستمری را با توجه به مقتضیات موجود در هر کشور اعمال کردند. در این مقاله سعی شده است تا به صورت پایه ای به تحول مفهوم حمایت اجتماعی در کشورهای عضو اتحادیه اروپا در بستر نظریه دولت رفاه اشاره شود. هرچند باید در نظر داشت میزان توسعه یافتگی و وضعیت صندوق ها در بین این کشورها به یک اندازه نیست؛ لیکن نقش اتحادیه اروپا برای اعمال اصلاحات در برنامه های صندوق های بازنشستگی کشورهای عضو شایان توجه است.A Legal Analysis of the Pension Fund System in the European Union
The management and status of pension funds have always been a major concern in modern societies. In terms of functions, these funds have a multifaceted impact. The deterioration of pension funds can have serious effects on society and the economy. The situation of pension funds in Europe has long been under scrutiny, and legal studies in this area are conducted with foresight and caution. Officials realized that neglect of the pension funds could engulf these funds in a crisis of legitimacy and efficiency. Therefore, they implemented continuous reforms according to the requirements of each country. In this paper, an attempt has been made to examine the evolution of the concept of social support in European countries in the context of the welfare state. However, it should be borne in mind that the level of development of the funds is not the same among European countries. Also, the role of the European Union in implementing reforms in the pension programs of member states is significant.
