چکیده
بیت المقدس، به عنوان شهری با جایگاه ویژه مذهبی و تاریخی، از زمان اشغال آن توسط اسرائیل و تلاش های مستمر برای تغییر وضعیت حقوقی، جمعیتی و جغرافیایی آن، موضوعی مناقشه برانگیز در حقوق بین الملل بوده است. مقاله حاضر با استفاده از اسناد تاریخی و حقوقی، بر اساس اصول و قواعد حقوق بین الملل به تحلیل وضعیت حقوقی بیت المقدس در پرتو نظر مشورتی دیوان بین المللی دادگستری در تاریخ ۱۹ ژوئیه ۲۰۲۴ می پردازد. در نظر مشورتی اخیر، دیوان ضمن تمرکز بر بیت المقدس شرقی، بر لزوم اعمال اصول و قواعد حقوق بین الملل بر کل شهر تأکید کرده است. در این نظر مشورتی فقط به بخش بیت المقدس شرقی پرداخته و اقدامات اسرائیل در آنجا مغایر اصول و قواعد حقوق بین الملل شناخته شده است. اما چنین به نظر می رسد که یافته های دیوان در خصوص بیت المقدس شرقی قابل تعمیم به بیت المقدس غربی است و گامی مهم برای تحقق عدالت و روشن شدن وضعیت این شهر است.The Legal Status of Jerusalem in the Light of the Advisory Opinion of the International Court of Justice on Israeli Policies and Practices in the Occupied Palestinian Territories
Jerusalem, as a city with a special religious and historical status, has been a controversial issue in international law since its occupation by Israel and continuous efforts to change its legal, demographic and geographical status. Using historical and legal documents, this article analyzes the legal status of Jerusalem in light of the advisory opinion of the International Court of Justice on 19 July 2024, based on the principles and rules of international law. In its advisory opinion, the Court, while focusing on East Jerusalem, emphasized the need to apply the principles and rules of international law to the entire city. In the advisory opinion, it only addressed the East Jerusalem section and recognized that Israel’s actions there were contrary to the principles and rules of international law. However, it seems that the Court’s findings regarding East Jerusalem can be generalized to West Jerusalem and are an important step towards achieving justice and clarifying the status of this city.
