چکیده
خریدوفروش کودک ممیز، به منزله تصرف مالی که مبتنی بر قصد و اختیار است، باعث چالش میان فقهای اسلامی و حقوق دانان ایرانی شده است. بررسی و ارزیابی دیدگاه های قابل طرح در مسأله صحت و بطلان خریدوفروش کودک ممیز و دست یابی به دیدگاهی شایسته، هدف این پژوهش است. پژوهش حاضر، توصیفی- تحلیلی و با استفاده از ابزار کتابخانه ای انجام شده است. مشهور فقهای امامیه و شافعی ها، خریدوفروش کودک را باطل دانسته و در مقابل، برخی باوجود رشد کودک یا کم ارزش بودن مورد معامله، قائل به صحت شده اند. در دیدگاه میانه ای، دادوستد کودک ممیز به طور مطلق باطل دانسته نشده، بلکه در صورت وجود اجازه ولی معتبر است که برخی از فقهای امامیه و مذاهب اهل سنت آن را پذیرفته اند. برخی از حقوق دانان نیز به این دیدگاه میانه فقها متمایل شدند و بر اساس آن از ماده 1211 ق. م. استظهار نمودند. برآیند پژوهش حاضر این است که علاوه بر اذن ولی کودک ممیز، به رشد وی نیز باید توجه شود.A Comparative Study on the Validity of Financial Transactions by Children in Iranian Contemporary Jurisprudence and Law
The practice of buying and selling by children, characterized as a financial transaction based on intention and discretion, has presented a challenge for Islamic and Iranian jurists. The research aims to investigate and evaluate various perspectives regarding the validity or invalidity of such transactions, with the goal of reaching a balanced viewpoint. The research adopts a descriptive-analytical approach and relies on library resources for data collection. Notably, renowned Imamiyyah and Shafi'i jurists have deemed the financial transactions by children to be invalid. Conversely, some scholars argue for its validity despite factors such as the child's age or the transaction's low value. A middle-ground perspective suggests that the transactions by a child is not categorically invalid but requires permission, a standpoint supported by certain jurists from the Imamiyyah and Sunni schools. Additionally, this view finds support in Article 1211 of the Iranian Civil Code. Some jurists have also shown inclination towards this middle-ground perspective.
