جستاری در علل ظهور عمل گرایی در سیاست کیفری جرائم اقتصادی

چکیده
تأکید نمادین بر موضوع مبارزه با جرائم اقتصادی و بی اعتنایی به نظریات کارشناسی و علمی سبب شده عمل گرایی به حوزه سیاست کیفری جرائم اقتصادی نفوذ پیدا کند. به گونه ای که کسب وجهه سیاسی توسط متولیان دولتی در نزد افکار عمومی از جمله اهداف اصلی آن ها در مبارزه با جرائم اقتصادی تلقی می شود. سیاست های عمل گرا که در برابر خردگرایی و رویکردهای سنجیده و علمی مطرح می شوند با تأکید بر خواست مردم و مقتضیات روز جامعه، در برابر مسائل و مشکلات راهکارهایی مقطعی اتخاذ می نمایند. بررسی سیاست کیفری ایران در جرائم اقتصادی نشانگر آن است که به دلایل مختلف از جمله رسانه ای شدن جرائم اقتصادی، سیاسی شدن واکنش ها در جرائم مزبور، ضعف آگاهی عمومی و اقتصاد دولتی، عمل گرایی به حوزه جرائم اقتصادی نفوذ پیدا کرده است. یافته های پژوهش نشانگر آن است که عمل گرایی در حوزه سیاست گذاری ماهوی پیرامون مبارزه با جرائم اقتصادی در جرم انگاری های مبتنی بر رویدادهای پیش آمده، تعیین ضمانت اجراهای کیفری با توجه به مقتضیات روز جامعه، قانونگذاری توسط نهادی غیر از قوه مقننه و مبنا قرار دادن امنیت حکومت در جرم انگاری تجلی یافته است. روش تحقیق در این پژوهش توصیفی و تحلیلی است و در گردآوری داده های آن علاوه بر تجزیه و تحلیل قوانین و مقررات، گفتمان سیاستگذاران کیفری مورد بررسی قرار گرفته است.Causes of the Emergence of Pragmatism in the Criminal Policy of Economic Crimes
The symbolic emphasis on the issue of combating economic crimes and the disregard for expert and scientific theories have caused pragmatism to penetrate the field of economic crime criminal policy. In such a way gaining political prestige by government officials in the eyes of public opinion is considered as one of their main goals in the fight against economic crimes. Pragmatic policies that are opposed to rationalism and prudent and scientific approaches, by emphasizing the will of the people and the current needs of society, adopt cross-cutting solutions to issues and problems. An examination of Iran's criminal policy on economic crimes shows that pragmatism has infiltrated the field of economic crimes for various reasons, including the media coverage of economic crimes, the politicization of reactions to these crimes, the lack of public awareness and the state economy, and pragmatism. Findings indicate that pragmatism in the field of substantive policy on combating economic crimes in criminalization is based on events, determining the guarantee of criminal execution according to the requirements of society, legislation by an institution other than the legislature and the basis of Government security is manifested in criminality. The research method in this research is descriptive-analytical and in collecting its data, in addition to analyzing the rules and regulations, the discourse of criminal policymakers has been examined.
