صلاحیت دیوان عدالت اداری در رسیدگی به اعتراض از آرای مراجع شبه قضایی «تأملی بر یک رأی» (مقاله علمی وزارت علوم)

چکیده
مستند به بند 2 ماده 10 قانون تشکیلات و آیین دادرسی دیوان عدالت اداری در نظم حقوقی ایران، نظارت قضایی بر آرای صادره از مراجع شبه قضایی در صلاحیت دیوان عدالت اداری قرار گرفته است. سوالی که راجع به این صلاحیت دیوان عدالت اداری در این مقاله بررسی شد، این بود که باتوجه به اَشکال مختلف مراجع شبه قضایی از بُعد تشکیلاتی - سازمانی، حدود و قلمروی صلاحیت دیوان عدالت اداری در رسیدگی به اعتراض از آرای این مراجع چگونه تبیین می شود؟ بررسی های انجام شده حاکی از این نکته بود که نظارت قضایی بر آرا و تصمیمات مراجع شبه قضایی، فارغ از اینکه این مراجع با عضویت قاضی تشکیل شوند یا بدون عضویت قاضی، در صلاحیت دیوان عدالت اداری قرار دارد؛ مگر آنکه این صلاحیت دیوان، مستند به قانون، تحدید شده باشد. بر این مبنا، رأی وحدت رویه شماره 170 هیأت عمومی دیوان عدالت اداری که رسیدگی به شکایت از آرای هیأت های مستشاری دیوان محاسبات و محکمه تجدیدنظر این نهاد را خارج از صلاحیت دیوان عدالت اداری دانسته، مغایر با قانون است.Jurisdiction of the Court of Administrative Justice in dealing with objections to the rulings of quasi-judicial authorities "Reflection on a vote"
According to section 2 of the 10th article Law on the Organization and Procedure of the Administrative Justice Court the judicial supervision on the verdicts of quasi-judicial courts is delegated to Administrative Justice Court . In this article, this question has been addressed that, considering the variety of the organizational structure of the quasi-judicial institutions, how would analyse the limitations and the scope of jurisdiction of Administrative Justice Court In proceeding the appealing of the votes of these authorities ? The considerations revealed that, regardless of the presence of a judge in the quasi-judicial court, supervision on the quasi-judicial institutions is delegated to The Court, unless The Court is restricted by the law. Therefore, the uniformity decision No. 170 of the general committee of The Court that dismises The Court of processing the complaints on the verdicts of the board of directors of The Court of Audit and its appeal court, is in contradiction with rules
