وضعیت حریم خصوصی در پیشگیری وضعی از جرایم اقتصادی در پرتو پدرسالاری قانونی (مقاله علمی وزارت علوم)

چکیده
ازجمله تدابیر پیشگیرانه وضعی درخصوص جرایم اقتصادی که این روزها ترویج یافته، تشکیل واحدهای جامع اطلاعات مالی و نیز کنترل حساب بانکی شهروندان است. این تدابیر ماهیتی غیرکیفری و فنی تخصصی دارند. دسترسی گسترده به اطلاعات و داده های مربوط به فعالیت ها و اقدامات تجاری و اقتصادی شهروندان در فرآیند اجرای تدابیر پیشگیرانه فوق، به شکل قابل انکاری زمینه سوءاستفاده و نیز تنزل حریم خصوصی اطلاعاتی شهروندان را پدید می آورد. هدف مقاله حاضر بررسی تنزل حریم خصوصی اطلاعاتی در پیشگیری وضعی جرایم اقتصادی در پرتو پدرسالاری قانونی است. مقاله حاضر توصیفی تحلیلی است. مواد و داده ها نیز کیفی است و از فیش برداری در گردآوری مطالب و داده ها استفاده شده است. یافته ها نشان داد تئوری پدرسالاری قانونی به حکومت ها این اختیار را می دهد که برای به خیر و صلاح رسانیدن شهروندان همچون پدری دلسوز درصورتی که فعل یا ترک فعلی را در راستای منفعت و مصلحت آن ها تشخیص دهد، در اَعمال و زندگی آن ها مداخله نماید. دلیل قاطعی مبنی بر نفی اجرای تئوری پدرسالاری قانونی وجود نداشته، لکن چنانچه تدابیر پیشگیرانه وضعی مقارن با جنبه های فنی تخصصی و نه سلیقه ای گردند، احتمال تنزل حریم خصوصی اطلاعاتی شهروندان نیز به طور قابل توجهی کاهش می یابد. نتیجه این که اصول پیشنهادی حفاظت از حریم خصوصی شهروندان در فضای مجازی که توسط سازمان همکاری و توسعه اقتصادی تعرفه گردیده، چنانچه در این مسیر اجرا گردد هم خیر و مصلحت عمومی (امنیت اقتصادی) محقق می گردد هم حریم خصوصی اطلاعاتی شهروندان تنزل نمی یابد.The Role of Privacy in Preventing Economic Crimes in the Light of Legal Patriarchy
Among the preventive measures regarding economic crimes that have been promoted these days is the formation of comprehensive financial information units and the control of citizens' bank accounts. These measures are non-criminal and technical-specialized in nature. Wide access to information and data related to the activities the above preventive measures, undeniably creates the grounds for abuse and degradation of information privacy of citizens. The purpose of this article is to investigate the degradation of information privacy in the state prevention of economic crimes in the light of legal patriarchy. This article is descriptive and analytical. Materials and data are also showed that there was no decisive reason to negate the implementation of the theory of legal patriarchy, but if the preventive measures of the mentioned situation are matched with the technical-expert aspects and not the taste, the possibility of the deterioration of the information privacy of the citizens will be significantly reduced. The theory of legal patriarchy gives governments the authority to intervene in their actions and lives for the benefit of the citizens like a caring father if it recognizes the current act or omission in line with their benefit and expediency. If the proposed principles of protection of citizens' privacy in cyberspace, which are established by the Organization for Economic Cooperation and Development, are implemented in this direction, both good and public interest (economic security) will be achieved, and the information privacy of citizens will not be degraded.
