جایگاه حقوق زندانیان کیفری در گستره حکمرانی شایسته اسلامی

چکیده
حقوق زندانیان کیفری از موضوعات مهمی است که همواره محل بحث و نظر بوده است. یکی از چالش های اساسی حقوق زندانیان، میزان و گستره این حقوق است که نیازمند بحث و بررسی است. بر همین اساس هدف مقاله حاضر جایگاه حقوق زندانیان کیفری در گستره حکمرانی شایسته اسلامی است. این مقاله توصیفی تحلیلی است و از روش کتابخانه ای برای بررسی موضوع مورد اشاره استفاده شده است. یافته ها بر این امر دلالت دارد که حکمرانی شایسته با بهره گیری از اصول و شاخصه هایی چون تعلیم و تربیت الهی، علم و تقوا و تقوامداری حکمرانان، تحقق قسط و عدالت، حق مداری در قضاوت، توحیدمحوری و خداترسی و سرانجام نظارت با محوریت پیش انگاره عدالت، به مثابه مکمل اصول حاکم بر حقوق فرد زندانی عمل نموده، تبلور حقوق ایشان را عینی تر و قابل دسترس تر خواهد ساخت، نتیجه این که تحقق حقوق زندانیان کیفری در گستره حکمرانی شایسته اسلامی نیازمند توجه ویژه به بخش خصوصی و جامعه مدنی به عنوان عناصر مهم حکمرانی شایسته است، زیرا باوجود دولتی بودن اکثر نهادها و سازمان های مجری و ناظر بر حقوق افراد زندانی، بحث حقوق افراد زندانی را چه از جنبه فردی و چه از جنبه نگاه جامعه جهانی به وضعیت حقوق بشر به چالش کشیده، عدم وجود و حضور یک نهاد مستقل غیردولتی به خصوص از حیث ضمانت اجرا معضلی اجتناب ناپذیر است.The Position of the Rights of Criminal Prisoners in the Scope of Islamic Decent Governance
The rights of criminal prisoners are important issues that have always been the subject of debate. One of the basic challenges of prisoners' rights is the amount and scope of these rights, which needs to be discussed. Based on this, the purpose of this article is the position of the rights of criminal prisoners in the scope of Islamic decent governance. This article is descriptive and analytical, and the library method was used to investigate the mentioned topic. The findings indicate that good governance by using principles and indicators such as divine education and training, knowledge and piety and piety of the rulers, realization of installments and justice, fairness in judgment. It acts as a supplement to the principles governing the rights of the imprisoned person, and the crystallization of their rights will make them more objective and accessible. The result is that the realization of the rights of criminal prisoners in the scope of decent Islamic governance requires special attention to the private sector and civil society as important elements of decent governance; Because despite the fact that most of the institutions and organizations that implement and monitor the rights of imprisoned people are governmental, the discussion of the rights of imprisoned people has been challenged both from the individual aspect and from the aspect of the world community's view of the human rights situation.
