چکیده
حق حفاظت از حریم خصوصی و اطلاعات شخصی از جمله حقوق و آزادی هایی است که هدف آن همسو با حقوق بشر به دنبال حمایت از حقوق اشخاص و احترام به حقوق بنیادین بشر است. شناسایی حق داشتن حریم خصوصی و اطلاعات شخصی و محافظت از آن در حقوق و تعیین ضمانت اجراهای حقوقی و کیفری به ویژه با توجه به اینکه این حوزه مملو از مشکلات عدیده است می تواند چالش برانگیز باشد. هدف این مقاله، تدقیق در بحث حفاظت از حریم خصوصی و اطلاعات شخصی است و برای درک بهتر قوانین در این حوزه، مطالعه تطبیقی صورت گرفته است. سؤال این مقاله این گونه مطرح شده است که چهارچوب قانونی برای حفاظت از حریم خصوصی و اطلاعات شخصی در حقوق ایران و کانادا چگونه است؟ آیا قوانین ایران در این زمینه همسو با سایر کشورها پیشرفت نموده است؟ در این پژوهش که به شیوه توصیفی تحلیلی است، پس از بررسی مفهوم حریم خصوصی و اشاره به قوانین داخلی و اسناد بین المللی تدوین شده در این خصوص به تفصیل به بررسی نحوه حفاظت از حریم خصوصی و اطلاعات شخصی در حقوق کانادا پرداخته خواهد شد و در نهایت پس از بررسی حفاظت از حریم خصوصی و اطلاعات شخصی در حقوق ایران و کانادا بیان می گردد که تدوین قانونی جامع و واحد در این خصوص در حقوق ایران الزامی می باشد و شایسته است همانند پیشرفت هایی که در سال های اخیر و به ویژه پس از توسعه فناوری دیجیتال در خصوص این موضوع در حقوق سایر کشورها ایجاد گردیده است، در حقوق ایران نیز قانونی واحد و جامع تدوین و خلأهای قانونی این موضوع رفع گردد.Protection of Privacy and Personal Information: A Comparative Study between Iranian Law and Canadian Law
The right to protection of privacy and personal information is one of the rights and freedoms that its aim is to protect the rights of individuals and respect to fundamental human rights. Identification the right to privacy and personal information and protecting it in law and determining the legal and criminal sanction, especially considering that this area is full of many problems can be challenging. The purpose of this article is to examine the protection of privacy and personal information and for understanding the laws in this area better; a comparative study has been conducted. The question of this article is what is the legal framework for the protection of privacy and personal information in Iranian and Canadian law? And Has Iranian law developed in line with other countries? In This research has studied the relevant sources and collected information by descriptive-analytical method After examining the concept of privacy, the protection of privacy and personal information in Canadian and Iranian law will be examined in detail, and finally it will be stated that a comprehensive and unified law is required in Iranian law. It is worthy, as progresses that accrue on this issue in other countries law in recent years, a single and comprehensive law should be formulated in Iranian law and legal gaps in this issue should be eliminated.
