چکیده
زمینه و هدف: قراردادهای هوشمند از قراردادهای نوین در حقوق قراردادهاست. در این مقاله، به تحلیل کارکرد قراردادهای هوشمند در ایجاد اسناد پرداخته می شود. مواد و روش ها: مقاله حاضر توصیفی تحلیلی بوده و از روش کتابخانه ای استفاده شده است. ملاحظات اخلاقی: در این مقاله، اصالت متون، صداقت و امانت داری رعایت شده است. یافته ها: قراردادهای هوشمند دارای کارکردهای مختلفی است. ازجمله این کارکردها می توان به انتقال دارایی ها، تأیید هویت، ایجاد اسناد قانونی، و مدیریت تراکنش های مالی اشاره کرد. قراردادهای هوشمند یکی از نوآوری های حیاتی فناوری بلاک چین هستند که به ایجاد اسناد و معاملات بدون واسطه کمک می کنند. این تکنولوژی مبتنی بر قراردادهای هوشمند، امکان ایجاد و اجرای خودکار قراردادها را با کمک کدهای برنامه نویسی قابل اجرا بر روی بلاک چین فراهم می کند. نتیجه : در یک اقتصاد پررونق و پویا، مالکیت یک مفهوم مهم به حساب می آید و بخش مهمی از فرایند اعتماد سازی در معاملات را به خود اختصاص می دهد. امروزه قراردادهای هوشمند مبتنی بر بلاک چین به عنوان تضمین کننده حقوق مالکیت اشخاص و سازمان ها مقبولیت قابل توجهی پیدا کرده اند. این ابزار شاید امیدوار کننده ترین راهکاری باشد که تا به امروز در برطرف کردن چالش های ثبت مالکیت دارایی ها ایجاد شده؛ چراکه فرآیند احراز هویت را ساده تر و ایمن تر، هم چنین اعتماد را از طریق شفافیت تقویت می کند.Smart contracts from a jurisprudential perspective and their functions in creating documents, financial and capital markets

Results: Smart contracts have different functions. These functions include transferring assets, verifying identity, creating legal documents, and managing financial transactions. Smart contracts are one of the vital innovations of blockchain technology that help create documents and transactions without intermediaries. This technology based on smart contracts allows the creation and automatic execution of contracts with the help of executable programming codes on the blockchain.
Conclusion: In a prosperous and dynamic economy, ownership is an important concept and occupies an important part of the process of building trust in transactions. Today, blockchain-based smart contracts have gained considerable acceptance as a guarantee of the property rights of individuals and organizations. This tool is perhaps the most promising solution that has been created so far in solving the challenges of registering the ownership of assets; Because it makes the authentication process simpler and safer, it also strengthens trust through transparency.
