بررسی تقدّم مقررات حقوق محیط زیست بر حکم تحلیل انفال (مقاله علمی وزارت علوم)

چکیده
در اینکه آیا حکم تحلیل انفال برای شیعیان مقدّم است یا رعایت مقررات محیط زیست و کدام یک بر دیگری ارجحیّت دارد، بایستی ماهیت، عمومیّت و آثار هر دو حکم یعنی حکم تحلیل انفال و نیز ضرورت حفظ محیط زیست، موردتوجه قرار گیرد، از طرفی حق داشتن محیط زیست سالم یکی از مصادیق حقوق هم بستگی است که نسل سوم حقوق بشر را شامل می شود. از سوی دیگر انفال و مالکیت آن و نحوه توزیع منابع طبیعی، موضوعی است که در حفاظت از محیط زیست سالم، نقش بسزائی دارد. هرچند در اینکه تصرّف در انفال برای شیعیان مباح است یا خیر؟ بین فقها اختلاف نظر وجود دارد، لکن امروزه حفاظت از محیط زیست سالم از مرزها عبور کرده و جنبه عمومی بین المللی به خود گرفته است. به طوری که در نسل سوم حقوق بشر، یکی از مصادیق عمده آن به شمار می رود. لذا علاوه بر قوانین داخلی و نیز قواعد حقوقی مانند قاعده لاضرر که به نوعی حکم تحلیل انفال را تحدید می نمایند، امروزه مقررات بین المللی نیز درجهت تحقّق داشتن محیط زیست سالم برای نوع بشر، بهره برداری از انفال توسط مردم را محدود خواهد نمود.Review the Right of Environmental Regulations to Take Precedence over the Anfal Analysis Order
In order to prioritize the Anfal analysis order for the Shiites or to observe environmental regulations and which is superior to the other, the nature, generalizability and effects of both judgments, namely, the Anfal analysis and the necessity of environmental protection, must be taken into consideration, on the other hand, the right having a healthy environment is one example of solidarity rights that includes the human right of the third generation. On the other hand, Anfal and its ownership and distribution of natural resources are a matter of great importance in protecting the healthy environment. However, is it possible to capture Anfal for Shiites? There is a controversy between jurists, but today, protecting the healthy environment has crossed the borders and has become a global public. As in the third generation of human rights, it is one of its main examples. Therefore, in addition to domestic laws and legal rules such as the rule of law that impose a kind of anfal analysis, today's international regulations will limit the use of anfals by humans in order to achieve a healthy environment for humankind.
