ویژگی های یک قاضی خوب؛ اصول اخلاق قضایی و رفتار حرفه ای

چکیده
ابهام زدایی، ایضاح و تکریم ویژگی ها و فضیلت های قضات شایسته سبب می شود قضاتی که فاقد این فضیلت ها هستند نیز در یک فرایند مداوم یادگیری و تقلید، شایستگی های خود را افزایش دهند و نهایتاً این فرایند به بهبود و ارتقاء جایگاه دستگاه قضا در افکار عامه جامعه منتج شود. مقاله پیش رو در راستای دستیابی به هدف مزبور، با رویکردی تاریخی-مقایسه ای به بررسی فضیلت های قضایی در ادوار تاریخی، فرهنگ های حقوقی متفاوت و نظریات مطرح در علم حقوق می پردازد و به صورت اجمالی به نقش قضات در اروپا و بازتعریف آن تحت تأثیر پدیده های نوظهوری چون بین المللی شدن قوانین و اهمیت یافتن منشور حقوق بشر اشاره می کند. افزون بر آن، پژوهش حاضر با انجام نظرسنجی از قضات شاغل، قضات کارآموز و دانش آموختگان حقوق متقاضی شرکت در آزمون قضاوت، فضیلت ها و مهارت های قضات شایسته را شناسایی کرده و در کانون توجه قرار می دهد و در این راستا، این استدلال را مطرح می کند که قضات شایسته تجسم بخش ارزش های والایی چون استقلال و بی طرفی، قابل اعتماد بودن و اخلاق مداری خواهند بود.What Makes a Good Judge; Judicial Ethics and Professional Conduct
Disambiguation and shedding light on the judicial qualities and virtues of good judges would affect the judges who lack these qualities and virtues in the process of ongoing learning and emulation. Eventually, continuous expanding of this process will increase believes and trusts of public to a judicial system. For this reason, this article from a historical and comparative perspective explains judicial virtues in the past eras, various legal cultures and different scientific theories. Furthermore, in summary, the present study addresses judges ‘role in Europe based on current development in this continent such as the globalization of law and the importance of the Human Rights Declaration. In addition, this study identifies virtues and skills of the good judges conducting a survey of employed judges, trainee judges and graduate applicants attending the test of judgment In conclusion, it is argued that a good judge depicted the high values of Independence and impartiality, Trustworthiness and morality.
