چکیده
نهادهای مالی در بازار سرمایه بر اساس قانون و مقررات با سایر اجزای این بازار و یا فی مابین ارکان خود، در ارتباط اند. نقض این قوانین و مقررات موجب بروز ناهنجاری هایی در نظام حاکم بر آن ها می گردد که می تواند موجب بروز جرائم یا تخلفاتی گردد و پیگرد قانونی و به تبع آن مجازات و تنبیهات انضباطی را در پی داشته باشد. گاهی نیز میان ارکان نهادهای مالی در ارتباط با یکدیگر یا اشخاص ثالث ممکن است، اختلافاتی بروز کند که لزوماً ناشی از نقض مقررات کیفری نیست اما به نظم و کارایی آن ها آسیب می زند. به هر رو به منظور تضمین حقوق سرمایه گذاران و تنظیم روابط سایر اجزای آن ها، علاوه بر مجموعه مقررات و ضوابط، ضمانت اجرای قضایی و شبه قضایی نیز در قوانین و مقررات پیش بینی شده است. در این مقاله بر ماهیت هیئت داوری بورس و جایگاه آن در نظام قضایی ایران، حدود صلاحیت آن، قابلیت اعتراض آرا و امکان صدور قرار اناطه برای رسیدگی به تخلف در مراجع اداری یا انضباطی را بررسی کنیم.Dealing disputes in the arbitration board with emphasis on the issuance of a warrant

Anyway, in order to guarantee the rights of investors and regulate the relations of their other components, in addition to the set of rules and regulations, the guarantee of judicial and quasi-judicial enforcement is also provided in the laws and regulations. In this article, let's examine the nature of the Stock Exchange Arbitration Board and its position in Iran's judicial system, the limits of its jurisdiction, the ability to protest votes, and the possibility of requiring the issuance of a warrant if necessary conditions are provided.
