مطالعه حمل و نقل بین المللی دریایی در زمان تحریم های بین المللی علیه جمهوری اسلامی ایران با رویکرد قواعد و قوانین اینکوتِرمز

چکیده
قوانین بازرگانی بین المللی(اینکوتِرمز) قوانینی که ریسکِ جابجایی و انتقالِ کالا در مراحلِ حمل را بر عهده دارد، به مجموعه قوانین و مقرراتی که مرجع و راهنمای افراد برای واردات و صادرات در بازرگانی بین المللی است. این مقاله با بررسی فرضیه های مطرح شده به روش توصیفی_تحلیلی با هدفِ بررسی و مطالعه روش های بین المللی حملِ محموله های صادراتی و وارداتی با قواعد اینکوترمز به مطالعه جایگاه حمل و نقل و تجارت دریایی ایران در زمان تحریم های بین المللی با در نظر گرفتن اینکوترمز بر روی حمل و نقل ایران می پردازد. یافته ها بیان می دارند: افزایش روز افزون حمل و نقل در سطح بین المللی و نقش انکارناپذیر آن در تجارت بین المللی مقوله ای است که نیازمند درک متقابل متعاملین از قوانین اینکوترمز و بیع بین المللی کالا از میزان تعهدات و مسئولیت های طرفین در قراردادها می باشد. نتایج نشان می دهد که صنعت حمل و نقل دریایی تاثیر بسیار زیادی در مبادلات فرامرزی بخصوص بازرگانی و تجارت فراقارهای کشورمان دارد. ناوگان کشتیرانی ایران، یک ناوگان دریایی بزرگ است که با در اختیار داشتن چندین کشتی اقیانوس پیمای پیشرفته، در تمامی مسیرهای بین المللی دنیا فعالیت دارد. هرچند که با ایجاد تحریم های ظالمانه و فشار کنونی بر صنعت کشتی رانی را با کاهشِ سود حمل و نقل دریایی روبرو نموده است اما جمهوری اسلامی با پیشرفت های زیادی در ساخت شناور و کشتی سازی های عظیم راه پیشرفت و توسعه این صنعت را به نقطه اعتلای خود پیش رو دارد؛ تردید نداشته باشید که صنعت حمل و نقل دریایی ایران در سال های آینده میتواند سود سرشاری را از این راه به کشور تزریق کند.The study of international maritime transport during the international sanctions against the Islamic Republic of Iran with the approach of Incoterms rules and regulations
International trade rules (Incoterms) are a set of rules and regulations that are a reference and guide for people to import and export in international trade. This article examines the hypotheses presented in a descriptive-analytical method with the aim of investigating and studying the international methods of transporting export and import cargoes with Incoterms rules to study the position of Iran's shipping and maritime trade at the time of international sanctions, considering Incoterms on transportation and Iran pays. The findings state: the increasing increase of transportation at the international level and its undeniable role in international trade is a category that requires mutual understanding of the interlocutors of the laws of Incoterms and the international sale of goods of the extent of the obligations and responsibilities of the parties in the contracts.The results show that the maritime transport industry has a great impact on cross-border exchanges, especially the trade and commerce of our country. Iran's shipping fleet is a large marine fleet that operates in all international routes of the world with several advanced ocean-going ships. Although it has faced the reduction of the profits of maritime transport by creating cruel sanctions and the current pressure on the shipping industry, the Islamic Republic has made great progress in the construction of vessels and huge shipyards, the way of progress and development of this industry is moving forward to its exaltation point. Do not doubt that Iran's maritime transport industry can inject rich profits into the country in the coming years.
