تحلیلی بر مشکلات بزه دیدگی ثانویه مهاجران در فرآیند دادرسی(مطالعه موردی مهاجرین افغانستانی، عراقی، سوری و لبنانی)

چکیده
یافته های جرم شناسانه به این مسئله اذعان دارد که اگر توجه جدی به نقش و جایگاه بزه دیده صورت بگیرد تاثیر بسزایی در حل و فصل مسئله مجرمانه دارد و حتی در بسیاری از موارد باعث پیشگیری از بزه دیده واقع شدن دومین بزه دیدگان خواهد شد . یکی از اقسام بزه دیدگی که کمترین راه حل پیشگیرانه برای آن ارائه شده است بزه دیدگی دومین مهاجرین است. موضوع بیگانگان به عنوان یک اقلیت مهم که جمعیت کثیری را ذیل نام های مختلف مانند: پناهنده، مهاجر، گردشگر، ماموران سیاسی و ... در بر می گیرد؛ موضوع مهم و بحث برانگیزی در کشورهای دنیا است. تحقیق حاضر با هدف مطالعه و بررسی مشکلات بزه دیدگان مهاجر در فرایند دادرسی کیفری و یا بزه دیدگی دومین مهاجرین در فرایند دادرسی کیفری انجام شده است و سعی شده تا اثر نوع رفتار نهادهای رسیدگی کننده با بزه دیده و نقش آن در بزه دیدگی ثانویه مهاجرین تببین گردد. در پژوهش حاضر با روش توصیفی-تحلیلی از نوع کیفی(مصاحبه و مشاهده حضوری)، علل شکل گیری بزه دیدگی دومین مهاجرین موضوعاتی از قبیل: ترس مهاجرین از عودت به کشورشان، عدم حضور پلیس در مناطق مهاجرنشین، عدم رسیدگی و مختومه نکرده پرونده ها، طولانی بودن روند محاکمه، رسیدگی نکردن به بزه دیدگان مهاجر غیر قانونی که توسط پلیس بزه دیده قرار گرفته اند، بیشترین درصد را به خود اختصاص داده اند. در پایان چنین نتیجه گیری شده است که اولا یک قانون خاص برای مهاجرین و اتباع بیگانه در راستای حمایت از حقوق آنها در زمانی که بزه دیده قرار می گیرند تدوین گرددAn analysis of the problems of secondary victimization of immigrants in the judicial process (a case study of Afghan, Iraqi, Syrian, and Lebanese immigrants)

Since victimization is an important discussion in the field of criminology, one of the types of victimization for which the least preventive solution has been provided is the victimization of the second immigrants. Since foreigners (immigrants) are among the vulnerable sections of the society for various reasons; It is more likely to be victimized, especially the second victim. The present research has been conducted with the aim of studying and investigating the problems of migrant victims in the criminal proceedings or the secondary victimization of migrants in the criminal proceedings, and it has been tried to explain the effect of the type of behavior of the institutions dealing with the victim and its role in the secondary victimization of migrants.
