بازنگری در طبقه بندی جرائم در پرتو عیارسنجی نوین از جرم (مقاله علمی وزارت علوم)

چکیده
در عصر حاضر با رشد فزاینده علم و فناوری های نوین و به موازات تحولات بنیادین در ارزش ها و هنجارها و تعدد و تکثر و درهم تنیدگی سیستم های اجتماعی و سیاسی، ماهیت، شکل و تنوع و شیوه ارتکاب جرائم نیز بسیار متحول گردیده است. نظر به اینکه جرم در بستر شرایط اجتماعی ظهور می کند، در این پژوهش در یک مطالعه میان رشته ای بین دانش جرم شناسی و علوم استراتژیک با روش «توصیفی-تحلیلی» و با بهره گیری از معیار تقسیم بندی نوین اجتماعی در صدد هستیم تا تقسیم بندی نوینی از جرائم منطبق بر شرایط پیچیده مذکور را ارائه نماییم. با توجه به دستاوردهای این پژوهش، بر خلاف نظام طبقه بندی عمده و رایج، با الهام از الگوی «نظام مدیریت جامعه در تلقی مدرن» و همچنین داده های علوم استراتژیک، جرائم را در سه سطح جدید: 1- استراتژیکی یا جرایم تصوری-پارادایمی؛ 2- تاکتولوژیکی یا جرایم مدیریتی و 3- تکنولوژیکی یا جرائم فردی و فناورانه طبقه بندی نموده ایم. در همین راستا بر خلاف تلقی رایج در آلیاژبندی جرائم به جرائم خرد (میکرو) و جرائم کلان (ماکرو)، این پژوهش در آلیاژبندی نوینی، جرائم را در چهار لایه ریز (نانو)، خرد (میکرو)، کلان (ماکرو) و ابر (سوپر) بر اساس دو معیار سیبل یا محیط آماج جرم و از طرفی آسیب های وارده تقسیم بندی نموده است. در نهایت از تلفیق مباحث فوق، در یک ساختار ماتریسی می توان به عیارسنجی جدیدی از جرائم در قالب یک دکترین دست یافت که در این پژوهش از آن تحت عنوان «عیارسنجی جرائم» یاد می شود.A review of the classification of crimes in the light of the new grading of crime

According to the achievements of this study, unlike the major classification system, inspired by the model of "community management system in modern perception" as well as strategic science data, crimes in three new levels: 1- Strategic or imaginary-paradigm crimes ; 2- We have classified tactological or managerial crimes and 3- technological or individual and technological crimes. In this regard, contrary to the common perception in the alloying of crimes into Micro and Macro crimes, this research in the new alloy, crimes in four layers Nano, Micro, Macro And Super is divided according to the two criteria of Sibel or the target environment of the crime and on the other hand the damages. Finally, by combining the above topics, in a matrix structure, a new classification of crimes in the form of a doctrine can be achieved, which in this research is referred to as "crime Rating ".
