بررسی روش شناختی چگونگی کشف سیره عقلا در پژوهش های عالی فقه و اصول

چکیده
سیره عقلاء کاربرد گسترده ای در فقه، قواعدفقه و اصول فقه داشته و نقش آن در استنباط احکام امری بدیهی است. اگر بنای عقلاء حجیت نداشته باشد، روابط انسانها و نظم زندگی آنها مختل میشود. حال بحث در این است که فقیه محترم نویسنده این جمله، چگونه این سیره عقلاء را (آنهم از آغاز تمدن بشری)کشف کرده است. امروزه محققان برای کشف نظرات و شیوه عمل گروه های خاصی از انسان ها، پس از تعیین جامعه و نمونه آماری، از روش های نوین نظرسنجی مانند مشاهده علمی، مصاحبه و پرسشنامه (و تحلیل های آماری) استفاده می کنند. با توجه به وحدت ملاک، برای کشف نظر، روش و سیره عقلاء نیز باید چنین شود. در این پژوهش به کیفیت کشف سیره عقلاء از سوی علمای معظم قدیم و معاصر پرداخته شده و بدین منظور کتب علمای قدیم از حیث چگونگی کشف سیره عقلاء بررسی شده و از برخی از علمای معاصر سوالاتی در این باره پرسیده شده و نتیجه آن در تحقیق ارائه شده است که علمای بزرگوار در کشف سیره عقلاء از روش های نوین تحقیق مانند نظرسنجی، پرسشنامه و مصاحبه استفاده نکردند و اصولا با جامعه آماری، نمونه آماری و نظرسنجی از آحاد جامعه خردمندان، سروکار نداشته اند.Methodological studding of discovery of wise people's method in high jurisprudence and osoul researches.
The wise people has a wide usage in jurisprudence, the principles of jurisprudence (osoul),. If the structure of the wise people does not have the authority, the relations of humans and the order of their lives are disrupted and the differences expand.. Here is the discussion how the jurisprudents discover the Wise people. Nowadays, the authors discover the new research of the Wise people by using surveys such as scientific observation, questionnaire, and interview. This research has been addressed the quality of the discovery of Wise people by the great and modern social researchers. In the books of the primary jurisprudents have investigated how the rational method was discovered, as well as about this questions have been asked from contemporary jurisprudents, and the result is presented in the research. The great jurisprudents did not use modern methods of research such as surveys, questionnaire, interview, and did not deal with the statistical society, statistical sample and surveys from the wise men's community.
