حل تعارضات حقوقی زنان در خانواده در بستر اصل تحکیم (مقاله علمی وزارت علوم)

چکیده
نهاد خانواده در هر جامعه ای دارای اهمیت است، به همین جهت ثبات آن تضمین کننده ثبات جامعه به شمار می رود. استحکام خانواده امری است که مورد توجه قوانین (چه الهی و چه بشری) قرار گرفته است. در حقوق ایران نیز در قوانین متعدد به این موضوع اشاره شده که مهمترین آن اصل 10 قانون اساسی است که اصل تحکیم را در حقوق خانواده به عنوان اصلی بنیادی و راهنما مطرح کرده است. اصل تحکیم به عنوان یک اصل کلی حقوقی، راهنمای قانونگذار در تدوین قوانین و رویه قضایی در تفسیر و اعمال قوانین می باشد. مطابق این اصل هر آنچه موجب استحکام خانواده شود پذیرفته و هرچه موجبات تزلزل آن را فراهم آورد منفور است. با توجه به اهمیت این اصل در نزد شارع مقدس، می توان آن را مبنای کلیه اصول حاکم بر خانواده دانست؛ اصولی همچون ساختارنگری به خانواده، عدالت محوری، مدیریت هدفمند خانواده، تقسیم کار و همکاری و وفاداری. از سویی در عرصه خانواده شاهد تعارضاتی هستیم که به ظاهر حل ناشدنی است، عدم توازن برخی حقوق و تکالیف زوجین که منجر به عدم رضایت افراد و ایجاد تنش میان آنان می گردد. توجه صحیح به اصل تحکیم و اصول مبتنی بر آن را می توان ضامن استحکام خانواده و برطرف کننده تعارضات مذکور دانست. به نظر می رسد، قانونگذار محترم خانواده و نیز مجریان آن، توجه لازم به این اصل کلی حقوقی را نداشته و لذا به رسمیت شناختن و اتخاذ رویکرد مناسبتر قانونگذاری و رویه قضایی به این اصل لازم می نماید.Resolving Women's Legal Conflicts in the Context of the Principle of Family Consolidation
The family institution in every society is important, so its stability guarantees the stability of society. The family consolidation has been considered by the laws (both divine and human). In Iranian law, this issue has been mentioned in several laws, the most important of which is Article 10 of the Constitution, which has introduced the principle of consolidation in family law as a fundamental and guiding principle. The principle of consolidation, as a general legal principle, is the guide of the legislator in formulating laws and judicial procedure in interpreting and applying laws. According to this principle, anything that strengthens the family is accepted, and anything that causes it to be weakened is hated. Given the importance of this principle in Holy Shari'a, it can be considered the basis of all the principles governing the family; Principles such as structuralism in the family, justice-oriented, purposeful family management, division of labor and cooperation and loyalty. On the other hand, in the field of family, we see conflicts that seem to be unresolved, the imbalance of some rights and duties of couples, which leads to dissatisfaction of individuals and creating tension between them. Proper attention to the principle of consolidation and the principles based on it can be considered as a guarantee of family strength and resolving the mentioned conflicts. Of course it is necessary to recognize and adopt a more appropriate legislative approach and judicial procedure to this principle.
