چکیده
زمینه و هدف: سازمان های غیردولتی در حال حاضر جایگاه عمده ای در توسعه پیدا کرده اند؛ زیرا سازمانهای مذکور می توانند با ایفای نقش های مختلف بخش دولتی را در امور توسعه یاری دهند و به طور مؤثری در فرآیند توسعه عمل کنند. بر همین اساس هدف مقاله حاضر نقش سازمان های غیردولتی در تحقق مسئولیت دولت ها در زمینه توسعه اقتصادی در فقه و حقوق است. مواد و روش ها: مقاله حاضر توصیفی تحلیلی است و از فیش برداری در گردآوری مطالب و داده ها استفاده شده است. ملاحظات اخلاقی: در این مقاله، اصالت متون، صداقت و امانت داری رعایت شده است. یافته ها: از منظر فقهی، دولت مسئول و متعهد به توسعه اقتصادی است. از این منظر، ایجاد اشتغال، عمران و آبادی، ایجاد ثبات اقتصادی، ایجاد عدالت و عدم تبعیض و توازن اقتصادی و تنظیم بازار مهمترین مسئولیت های دولت در فرایند توسعه اقتصادی است. سازمان های غیردولتی از مستحدثات فقهی است؛ اما در فقه در خصوص نقش و مشارکت مردم در توسعه اقتصادی در آیات و روایات تأکید زیادی شده است که این مشارکت در عصر حاضر می تواند در قالب سازمان های غیردولتی انجام شود. از منظر حقوقی نیز در اصول مختلف قانون اساسی و برنامه های پنج سال توسعه، وظیفه دولت در توسعه اقتصادی و ضرورت مشارکت مردم در این زمینه تصریح شده است. نتیجه : با توجه به رویکرد مثبت فقه و حقوق نسبت به مشارکت مردم در توسعه اقتصادی، لازم است زمینه حضور فعال سازمان های غیردولتی جهت ایفای نقش تاثیرگذار در توسعه اقتصادی فراهم گردد.The Role of Non-Governmental Organizations in Realizing the Responsibility of Governments in the Field of Economic Development in Jurisprudence and Law
Background and purpose : Non-governmental organizations have now found a major place in development because the aforementioned organizations can help the government sector in development matters process. Accordingly, the aim of this article is the role of non-governmental organizations in fulfilling the responsibility of governments in the field of economic development in jurisprudence and law.
Materials and Methods : This article is descriptive and analytical, and data collection was used to collect data.
Ethical Considerations : In this article, the originality of the texts, honesty and trustworthiness are observed.
Findings : From a jurisprudential point of view, the government is responsible and committed to economic development. From this point of view, creating employment, construction and settlement, the market are the most important responsibilities of the government in the process of economic development. Non-governmental organizations are one of the creations of jurisprudence, but in jurisprudence regarding the role and participation of people in economic development, it has been emphasized in verses and traditions that this participation can be done in the form of non-governmental organizations in the current era. From a legal point of view, the duty of the government in economic development and the necessity of people's participation in this field have been specified in various principles of the constitution.
Conclusion : Considering the positive approach of jurisprudence and law towards people's market in economic development, it is necessary to provide the ground for the active presence of non-governmental organizations to play an effective role in economic development.
