الزامات تحقق مدل توسعه انسانی در نظام قضایی ایران (مقاله علمی وزارت علوم)

چکیده
مدل توسعه انسانی یکی از اساسی ترین رویکردها در نظام قضایی است که تحقق آن تأثیر به سزایی در پیشگیری از جرم و تحول نظام قضایی دارد. بر همین اساس هدف مقاله حاضر، بررسی الزامات تحقق مدل توسعه انسانی در نظام قضایی ایران است. این مقاله توصیفی تحلیلی است و با استفاده از روش کتابخانه ای به بررسی موضوع مورد اشاره پرداخته است. یافته ها بر این امر دلالت دارد که تحقق عدالت اجتماعی و رفع نابرابری درآمدی، شفاف بودن وضعیت اقتصادی، آموزش، افزایش سطح بهداشت، رفاه و امید به زندگی، رفع فقر و بیکاری و تقویت فرهنگ قانون محوری از الزامات تحقق مدل توسعه انسانی در نظام قضایی ایران است. تعریف پیشگیری از جرم به عنوان وظیفه قوه قضاییه تأثیر مهمی در تحقق توسعه مدل قضایی در ایران ندارد، زیرا توسعه انسانی دارای ابعاد مختلف اقتصادی، اجتماهی، فرهنگی و سیاسی است که نیازمند یک رویکرد کلان و همکاری همه نهادی دولتی و غیردولتی است، البته ازجمله راهکارهایی که قوه قضاییه می تواند به عنوان محور و مسؤول اصلی در پیشگیری از جرم درجهت حصول به ویژگی فعال در تأمین بهداشت عمومی و قضایی در راستای توسعه انسانی در پیش گیرد، آن است که از طریق تعامل فعال با نهاهای حاکمیتی زمینه های مرتبط با توسعه انسانی را افزایش و وقوع جرم را به حداقل رسانده و براساس میزان نابرابری های موجود، در اندیشه متناسب سازی سیاست های جنایی باشد.The Requirements for the Realization of the Human Development Model in Iran's Judicial System
The human development model is one of the most fundamental approaches in the judicial system, the realization of which has a significant impact on the prevention of crime and the transformation of the judicial system. Therefore, the purpose of this article is to examine the requirements for the realization of the human development model in Iran's judicial system. This article is descriptive and analytical, and it has investigated the mentioned subject by using the library method. The findings indicate that the realization of social justice and the elimination of income inequality, the transparency of the economic situation, education, increase, the level of health, well-being and life expectancy, the elimination of poverty and unemployment, and the strengthening of a law-oriented culture are among the requirements for the realization of the human development model in the judicial system. It is Iran. The definition of crime prevention as the duty of the judiciary does not have an important effect on the realization of the institutions. Of course, among the solutions that the judiciary can take as the main axis and responsible in crime prevention in order to achieve an active feature in providing public and judicial health in line with human development, is to actively interact with the governing bodies of related fields. with human development and the occurrence of crime to a minimum and based on the level of existing inequalities, think of criminal policies.
