چکیده
محیط الکترونیکی اینترنت یکی از مدرن ترین وسیله انعقاد قراردادها و ایفای تعهدات ناشی از آن در عرصه معاملات تجارتی محسوب می شود.با توجه به عصرنقل و انتقال دیتا و ماهیت اعتباری آن باعث ایجاد دهکده جهانی و متصل شدن احاد جوامع مختلف بر یک بستر خاص شده است.یکی از مسائل نوظهور و شایع ،وجود بازار مالی فارکس است.این بازار به عنوان بزرگترین بازار مالی که متفاوت از بازارهای مشابه می باشد،اولا مستلزم شناخت ماهیت و کارکرد آن و ثانیا تببین آن از بستر فقهی برای مکلفین می باشد تا به وسیله ی آن از چالش های رو به رو جلوگیری شود.بابررسی و تنقیح عقیده ی صاحب نظران، سوالاتی پیرامون اصل پذیرش و ورود به این نوع بازار و ویژگی معاملات آن اعم از غرری ،ربوی،مختلل کننده نظام اقتصادی مطرح شده که سعی بر تامل و ایجاد نگرش جدیدی بر آن شده است.این پژوهش به عنوان یک فرضیه در نهایت به نفع رویکرد جواز قول معاملات در بازار فارکس استدلال می نماید.Jurisprudential reading of the feasibility of trading in the forex market

One of the emerging and common issues is the existence of the forex financial market. This market, as the largest financial market, which is different from similar markets, firstly requires knowing its nature and function, and secondly, explaining it from the jurisprudential basis for the obligees, so that by means of It avoids the challenges faced. Examining and revising the opinion of experts, questions about the principle of acceptance and entry into this type of market and the characteristics of its transactions, including extortion, usury, disrupting the economic system, have been raised, and an attempt has been made to reflect on it and create a new attitude. This research As a hypothesis, it ultimately argues in favor of the approach of allowing transactions in the forex market Also, according to Islamic laws, Muslims cannot earn profit with interest, and the swap account allows Muslim users to be exempted from receiving riba in their transactions, for this reason, a series of brokers open accounts for Muslims called Islamic accounts. There are transactions without interest.
