چکیده
سرقت یکی از شایع ترین آسیب های اجتماعی است. تعداد زیادی از پرونده های موجود در مراجع قضایی مربوط به سرقت است. این پدیده علاوه بر این که باعث ایجاد بی نظمی و هرج و مرج، مخدوش کردن حس امنیت، کم رنگ کردن انگیزه کار، تلاش و سرمایه گذاری در اجتماع می شود، موجبی برای احساس تهدید مالی و جانی در افراد و تزلزل در بنیان های نظم عمومی جامعه است. نگاهی بر آمار سرقت حکایت از افزایش وقوع آن در سطح جامعه دارد، لذا چاره اندیشی درخصوص پیشگیری از وقوع این پدیده در اهمیت و اولویت است. فقدان تحقیقات منسجم، منظم و پیوسته در زمینه پیشگیری از سرقت که برمبنا و محوریت علوم انسانی اسلامی باشد، نگارنده را بر آن داشت با ارائه راه حل ها و راهکارهای علمی و در عین حال کاربردی با هدف پیشگیری از آسیب های اجتماعی سرقت را با استفاده از ظرفیت های فقه، حقوق و علوم دیگر، مد نظر قرار دهد. هدف از پژوهش حاضر، شناسایی مهم ترین علل وقوع سرقت در کشور ایران و همچنین ارائه راهکارهای فقهیِ پیشگیری از این آسیب اجتماعی با روش توصیفی تحلیلی است. نتایج پژوهش حاضر نشان دهنده این مطلب است که با مداقه در منبع غنی فقه پویای اسلامی می توان راهکارهایی درجهت پیشگیری از وقوع پدیده سرقت ارائه داد که تا حدود زیادی در کاهش ایجاد این آسیب، نقش و تأثیر به سزایی خواهند داشت.Jurisprudential Solutions to Prevent the Social Damage of Theft
Theft is one of the most common social harms. A large number of cases in the judicial authorities are related to theft. In addition to causing disorder and chaos, distorting the sense of security, dimming the motivation of work, effort and investment in society, this phenomenon causes It is the feeling of financial and life threats in individuals and the instability in the foundations of the general order of the society. A look at the statistics of theft indicates an increase in its occurrence in society. Therefore, it is important and priority to think of a solution to prevent the occurrence of this phenomenon. lack of coherent, regular and continuous research in the field of theft prevention; which is based and centered on Islamic humanities, had the writer on it; By providing scientific and at the same time practical solutions and solutions with the aim of preventing social damage, consider theft by using the capacities of jurisprudence, law and other sciences. The purpose of the current research is to identify the most important causes of theft in Iran and also to provide jurisprudential solutions to prevent this social harm with a descriptive and analytical method. The results of the present research show that by studying the rich source of dynamic Islamic jurisprudence, solutions can be provided to prevent the occurrence of theft, which will have a great role and impact in reducing the occurrence of this damage.
