اجرای آرای دیوان داوری ورزش در سطح ملی

چکیده
دیوان داوری ورزش به عنوان نهاد اصلی حل وفصل اختلافات ورزشی، آرایی صادر می کند که تأثیرات عمیقی بر ورزش جهانی و ملی دارد. بااین حال، اجرای این آراء در سطح ملی با چالش هایی مانند تعارض با قوانین داخلی، محدودیت های قضایی و مقاومت فدراسیون های ورزشی مواجه است. این پژوهش به بررسی موانع حقوقی و عملی اجرای آرای دیوان داوری ورزش در سیستم های حقوقی ملی می پردازد و استدلال می کند که فقدان هماهنگی بین المللی و ضعف مکانیزم های اجرایی، اثربخشی این آراء را کاهش داده است. در پژوهش حاضر با استفاده از روش کیفی، منابع حقوقی معتبر، اسناد بین المللی و رویه های قضایی تحلیل شده اند. یافته ها نشان می دهند که تفاوت در نظام های حقوقی، به ویژه در کشورهای با سیستم های حقوقی عرفی و مدنی و همچنین مسائل حاکمیتی، اجرای آراء را دشوار می کند. این امر می تواند به نقض اصول عدالت ورزشی و حقوق ورزشکاران منجر شود. این پژوهش پیشنهاد می دهد که معاهدات بین المللی جدیدی برای الزام آور کردن اجرای آرای دیوان داوری ورزش تدوین شود، هماهنگی با قوانین ملی تقویت گرد و نهادهای ورزشی منطقه ای نقش فعال تری ایفاء کنند. همچنین، کمیته بین المللی المپیک و فدراسیون های جهانی باید مکانیزم های نظارتی ایجاد کنند. ضرورت اصلاحات حقوقی برای تضمین اجرای عادلانه آراء و حفاظت از حقوق ورزشکاران برجسته شده است. این پژوهش به گفتمان حقوقی در مورد تعادل بین خودمختاری نهادهای ورزشی و الزامات حقوقی ملی کمک می کند.Implementing the Decisions of the Court of Arbitration for Sport at the National Level
As the main body for resolving sports disputes, the Court of Arbitration for Sport issues rulings that have profound effects on global and national sports. However, the enforcement of CAS awards at the national level faces challenges, including conflicts with domestic laws, judicial limitations, and resistance from sports federations. In this study, using a qualitative method, authoritative legal sources, international documents, and judicial procedures have been analysed. The findings show that differences in legal systems, especially in countries with customary and civil law systems, as well as governance issues, make it difficult to enforce decisions This could lead to violations of the principles of sports justice and athletes' rights. The study suggests that new international treaties be developed to make the implementation of the Court of Arbitration for Sport's decisions binding, coordination with national laws be strengthened, and regional sports bodies play a more active role. The International Olympic Committee and world federations should also establish monitoring mechanisms. The need for legal reforms to ensure fair implementation of decisions and protect the rights of athletes has been highlighted. This research contributes to the legal discourse on the balance between the autonomy of sports institutions and national legal requirements
