چکیده
استفاده از تحریم ها به عنوان واژه ای آشنا در ادبیات حقوق و روابط بین الملل در سیاست خارجی کشورها بحث جدیدی نیست و حداقل از پس از جنگ جهانی اول به این سوء، به صورت ابزاری قوی در سیاست خارجی کشورها مطرح شده است. ایالات متحده آمریکا، به خصوص از سده بیست ویکم به صورت نظام مند از این نوع راهبرد در راهبرد خارجی خود علیه کشورهای مورد هدف استفاده می کند. در این زمینه سؤال این است که آیا تحریم های یکجانبه آمریکا می تواند مصداق تروریسم اقتصادی باشد یا خیر؟ به نظر می رسد اعمال تحریم های نامشروع یکجانبه ای چون تحریم های بانکی و دارویی به عنوان بخشی از راهبرد بزرگ علیه جمهوری اسلامی ایران، مخالف با مقررات و موازین حقوق بشری و حقوق بین الملل است و می تواند مصداق بارز تروریسم اقتصادی قلمداد شود. ضروری است در راستای توسعه حقوق بین الملل مقابله با تروریسم اقتصادی، اقدامات حقوقی بین المللی از سوی اعضای جامعه بین المللی در قالب تصویب کنوانسیونی بین المللی تدوین و تصویب شود.Unilateral Sanctions as a Manifestation of Economic Terrorism in International Law
The use of sanctions as a familiar term in the literature of law and international relations in the foreign policy of countries is not a new discussion and has been presented as a powerful tool in the foreign policy of nations at least since the end of World War I. The United States, especially since the twenty-first century, has systematically employed this type of strategy in its foreign policy against targeted countries. In this context, the question arises: can the United States' unilateral sanctions be considered a form of economic terrorism? It appears that the imposition of illegitimate unilateral sanctions, such as banking and pharmaceutical sanctions, as part of a broader strategy against the Islamic Republic of Iran, contradicts human rights regulations and international law and can be regarded as a clear example of economic terrorism. It is essential, in the pursuit of developing international law to combat economic terrorism, for international legal actions to be taken by members of the international community in the form of adopting and enacting an international convention.
