گذر از واقعیت به حقوق؛ نقش فن آوری در شکل گیری و تحولات حقوق مالکیت فکری با تاکید بر اختراعات سبز

چکیده
حقوق به عنوان دانش تنظیم کننده روابط اجتماعی، متاثر از عالم واقع است؛ لکن واقعیت ها پس از طی مراحلی پای به عالم حقوق می گذارند. اختراع دستگاه چاپ و موتور بخار و دستیابی انسان به این فناوری ها، باعث شکل گیری و توسعه رشته حقوق مالکیت فکری شد. این دو اختراع، زندگی انسان را متحول کرده و حقوق را مجبور به پذیرش دسته تازه ای از اموال یعنی اموال فکری کردند. از سوی دیگر حقوق مالکیت فکری با حمایت انحصاری از نوآوران کمک شایانی به پیشرفت جوامع کرد. این مقاله با مطالعه این ارتباط متقابل، به دنبال تبیین رابطه حقوق مالکیت فکری و فن آوری بوده و برای راستی آزمایی، اختراعات سبز و تاثیر و تاثر آن را در کانون توجه خود قرار داده است. زیرا با پیشرفت فن آوری و در خطر قرار گرفتن محیط زیست، ضرروت اختراعات سبز و دیگر نوآوری ها مطرح گردید. به عنوان نتیجه اجمالی می توان گفت: حقوق مالکیت فکری نتیجه فن آوری های قرون جدید و میسر شدن تولید انبوه توسط انسان بوده است و از دیگر سو حقوق مالکیت فکری بعد از پیدایش به توسعه فن آوری کمک شایانی نموده و امروزه لازمه تحقق اقتصاد دانش بنیان در جوامع است. مصداق بارزی بر صحت ادعای فوق، اختراعات سبز هستند که تلاش جدید بشر برای کاهش مخاطرات زیست محیطی بوده است و حقوق هم جهت تشویق و تنظیم گری این حوزه، عمل می کند.Transitioning from Reality to Law: The Role of Technology in Shaping and Evolving Intellectual Property Rights, with a Focus on Green Innovations

Additionally, intellectual property rights played a crucial role in fostering societal development by offering exclusive rights to inventors. This article explores the connection between intellectual property rights and technology, with particular attention to green innovations. As technological advances have brought about environmental challenges, the demand for green inventions and sustainable solutions has grown. In conclusion, intellectual property rights emerged alongside technological progress and mass production capabilities, and have significantly contributed to technological development since their inception. Today, these rights are vital for the advancement of a knowledge-based economy. Green inventions serve as a clear example of this relationship, representing human efforts to mitigate environmental risks, while the law works to support and regulate these innovations.
