شناسایی و استخراج چالش ها و موانع در اجرائی سازی روش های جایگزین حل و فصل اختلاف: یک مرور نظام مند ادبیات

چکیده
زمینه و هدف: روش های جایگزین حل اختلاف به عنوان روش هایی اساسی جهت کاهش ورود پرونده ها به دادگاه ها و افزایش صلح و سازش مورد توجه بسیاری از کشورها قرار گرفته است، اما همواره پیاده سازی این روش ها با مشکلات متعددی همراه بوده، به صورتی که در برخی موارد نه تنها پیاده سازی این روش ها به کاهش ورود پرونده ها کمک نکرده، بلکه باعث پیچده تر شدن پرونده نیز گردیده است. با توجه به مشکلات متنوعی که در زمینه ی اجرائی سازی روش های جایگزین حل اختلاف وجود دارد تاکنون مطالعه ای که به صورت جامع و نظام مند به بررسی این مشکلات بپردازد صورت نگرفته است. بر اساس شکاف مطرح شده، در این پژوهش از روش مرور نظام مند ادبیات جهت شناسایی و استخراج چالش ها و موانع در اجرائی سازی روش های جایگزین حل اختلاف استفاده شده است.روش پژوهش: جست وجو با هدف شناسایی مطالعات مرتبط با سوال پژوهش، در پایگاه استنادی Web of Science به 288 منبع از انتشارات علمی منتشر شده منجر گردید. با غربالگری مطالعات جهت گزینش منابع کلیدی ابتدا مطالعات بر اساس تناسب عنوان، مورد ارزیابی قرار گرفتند که در این مرحله 193 مطالعه انتخاب شد، سپس در مرحله ی بعدی به منظور متناسب بودن مطالعات با حوزه ی مورد نظر، چکیده، مقدمه و نتیجه گیری مطالعات منتخب بررسی شدند که با حذف مقالات غیر مرتبط 94 مقاله باقی ماند و در نهایت تمام متن مقالات باقی مانده برای کسب اطمینان از گزینش منابع مرتبط با موضوعِ تحت مرور، بررسی شدند که منجر به انتخاب 57 مقاله مرتبط گردید. در این پژوهش دانش مربوط به موانع و چالش های اجرائی سازی روش های جایگزین حل اختلاف مانند شوراهای حل اختلاف و سازمان های مشابه آن در سطح بین الملل، با استفاده از روش مرور نظام مند ادبیات کشف و یکپارچه سازی شده است.Identifying and Extracting Challenges and Obstacles in the Implementation of Alternative Dispute Resolution Methods: A Systematic Literature Review
Objective: Alternative dispute resolution has attracted the attention of many countries as a basic method to reduce cases entering the courts and increase peace and reconciliation, but implementation has always been plagued by numerous problems, so in some cases, not only has it not reduced the number of cases but has also complicated the case. While there are various problems associated with the implementation of alternative dispute resolution methods, no comprehensive and systematic study has been conducted to address them. To that end, this study used a systematic literature review to identify challenges and obstacles in the implementation of alternative dispute resolution methods.Methodology: Searching the Web of Science database for studies related to the research question led to 288 sources of scientific publications. By screening the studies, 193 studies were selected based on the appropriateness of their titles, and in the next stage, the abstract, introduction, and conclusion of the selected studies were examined to determine whether they were relevant to the field. After removing unrelated articles, 94 articles were left, and finally, all the text of the remaining articles was reviewed to ensure the selection of sources pertinent to the topic under review, leading to the selection of 57 articles. Through systematic literature review, this study has discovered and integrated knowledge related to obstacles and challenges of implementing alternative dispute resolution methods like dispute resolution councils and similar organizations at an international level.Result: by examining 57 filtered studies, 88 pieces of evidence were extracted from 33 sources, while no evidence was discovered from 24 others. In order to create a comprehensive view of this evidences, the combination of extracted pieces of evidence led to 2 groups of user problems and system problems, as well as 15 themes of factors.
