اصول و قواعد حقوقی حاکم بر حقوق شهروندی در فضای سایبر

چکیده
پیشرفت فناوریهای اطلاعات و ارتباطات در کنار کارکردهای مؤثّر آن بر امور متعدّد و متنوّع مرتبط با زندگانی بشری، موجد آسیبهایی برای حقوق شهروندی در فضای سایبر نیز بوده است؛ لکن لازمه گستره فضای سایبر این است که یک سری اصول و قواعد کلی حقوقی و دربرگیرنده ابعاد نظری حقوق شهروندی در فضای سایبر به تناسب بر تمام روابط و مناسبات موجود در این فضا حاکمیت نماید. در پژوهش حاضر با استفاده از منابع کتابخانهای و روش تحقیق توصیفی و تحلیلی، پاسخگوی مسئله حکم فرمایی اصول و قواعد حقوقی بر حقوق شهروندی در فضای سایبر است. اصل «لا ضرر» را میتوان در روابط میان شهروندان با دیگر اشخاص جامعه در فضای سایبر حاکم دانست و مآلاً از دو بعد تکلیفی و وضعی از ایراد هر گونه آسیب به حقوق شهروندی در فضای سایبر ممانعت به عمل میآورد و ضمان شخص زیانزننده را مقرّر نمود. از حیث قواعد حقوقی حاکم بر مناسبات حکومت با شهروندان در فضای سایبر نیز، اصل برائت در حوزه امور ماهوی و اصل دادرسی منصفانه در حوزه امور شکلی در برابر اختیارات و ابزارهای اعمال قدرت توسط حکومت، ضامن حفظ و صیانت از حقوق شهروندان در فضای سایبر به حساب می آید. اصل برائت باعث میشود تا شهروندان سایبری از مجرم شناخته شدن بدون مبنا مصّون باشند و اصل دادرسی منصفانه نیز مانع تضییع و یا تحدید حقوق شهروندی در فضای سایبر به بهانه تأمین امنیت در این فضا تلقی می شود.Legal principles and rules governing citizenship rights in cyber space
The development and advancement of information and communication technologies along with its effective functions on many and varied issues related to human life has caused damage to the rights of citizens in the cyber space. However, the extent of the cyber space requires that a series of general legal principles and rules governs all the relationships in this space. In the present research, using library sources and descriptive and analytical research methods, it is the answer to the issue of ruling legal principles and rules on citizenship rights in the cyber space. the principle of "prohibition of detriment" can be regarded as the ruling principle in the relations between citizens and other members of the society in the cyber space; this principle prevents any detriment to the rights of citizens in the cyber space, and guarantees the harmed person. In terms of the legal rules governing the relationship between the government and citizens in the cyber space, the principle of innocence in the field of substantive matters and the principle of fair trial in the field of formal matters against the powers and means of exercising power by the government guarantee the protection of the rights of citizens in the cyber space. The principle of innocence makes cyber citizens immune from being guilty without any basis and the principle of fair trial also prevents the violation or limitation of citizen's rights in the cyber space under the pretext of ensuring security in this space.
