چکیده
ما در این مقاله به دنبال بررسی دفاع مشروع در برابر ضابطین در حقوق ایران و حقوق بین الملل هستیم. از پژوهش فوق نتیجه گیری کردیم که همان طور که مردم و دولت از مأموران توقع دارند که در انجام دادن وظایف خود، جانب امانت و صداقت رعایت کنند باید به آنان نیز این اطمینان داده شود که به هنگام ایفای وظیفه مصون از هرگونه تعرض و تجاوز خواهند بود . بااین حال هر نوع مقاومتی که در مقابل مأموران دولت صورت می گیرد را نمی توان تمرد محسوب و مرتکب آن را مجازات نمود، بلکه مقاومت در برابر مأموران دولت، حالات متعددی دارد که در برخی موارد نه تنها تمرد محسوب نمی شود و مجازات ندارد بلکه با اجتماع شرایطی که در قانون ذکرشده، دفاع مشروع محسوب و مرتکب از هر نوع مسئولیتی مبرا خواهد بود.بااین حال هر نوع مقاومتی که در مقابل مأموران دولت صورت می گیرد را نمی توان تمرد محسوب و مرتکب آن را مجازات نمود، بلکه مقاومت در برابر مأموران دولت، حالات متعددی دارد که در برخی موارد نه تنها تمرد محسوب نمی شود و مجازات ندارد بلکه با اجتماع شرایطی که در قانون ذکرشده، دفاع مشروع محسوب و مرتکب از هر نوع مسئولیتی مبرا خواهد بود.Legitimate defense against law enforcers in Iranian law and international law
In this article, we seek to examine legitimate defense against bailiffs in Iranian law and international law. From the above research, we concluded that just as the people and the government expect officers to be trustworthy and honest in performing their duties, they should also be assured that they will be safe from any aggression while performing their duties. . However, any kind of resistance against the government officials cannot be considered as rebellion and the perpetrator should be punished, but resistance against the government officials has many situations, which in some cases is not only considered as rebellion and has no punishment, but with the combination of conditions that are stipulated in the law.
