قانون مندی و قانون گریزی از منظر قرآن، نهج البلاغه و دیدگاه امام خمینی

چکیده
قانون به دو معنی به کار میرود: یکی در امور اعتباری، وضعی و قراردادی و دیگری در امور حقیقی، نفسالامری و واقعی. هر جامعهای نیازمند نظم و انضباط اجتماعی است. همهی دانشمندان و خردمندان علوم اجتماعی در ایجاد جامعهی ضابطهمند و قانونگرا اتفاق نظر دارند. هدف از قانون، قانونمداری و قانونگرایی است. قوانین و مقررات وضع شده درجوامع آرمانی بر اساس عقل، وجدان و احساس نیست، بلکه آمیخته با وحی و الهام است که از طرف خداوند سبحان توسط انبیاء و بزرگان و معصومین (ع) در ارتباط با این احکام الهی و اسلامی هستند، به بشریت ابلاغ میگردد. جامعهی آرمانی تا وقتی موجه و مشروح است که حقوقی را که برای صیانت از آنها تشکیل شده است، نقض نکند بنابر این تنها چاره برای پایان دادن به هرج و مرج طبیعی، تیرگیها و تباهی های است. (جامعه دینی جامعه « اسلامی » ناشی از آن اقدام آحاد اجتماع به تشکیل جامعهی آرمانی مدنی، ص 52 ) در این مقاله سعی شده است با استفاده از روش تحقیق توصیفی - کتابخانه ای با عنایت به معنی واژهی قانون، قانونپذیری و قانونگرایی که ضرورت و نیاز جامعه است و همچنین مورد تجزیه و تحلیل قرار دهد. « اسلامی » عوامل ایجاد و یا موانع جوامع آرمانیThe Rule of Law and the Avoidance of the Quran, the Book Nahj and Imam Khomeini

(The religious community, civil society, p. 52) In this article, using descriptive research method – according to the word of the law library, law and legalism of the necessity community and the factors or barriers utopian societies "Islamic" was analyzed.
