چکیده
دادگاه های ایران به طور استثنائی صلاحیت رسیدگی به جرائم ارتکابی توسط مأموران و مستخدمان دولت در خارج از کشور را دارند. این صلاحیت بر مبنای اصل صلاحیت شخصی استوار گشته و اعمال آن در برخی موارد مستلزم رعایت اصل مجرمیت متقابل یا مضاعف است . مقاله حاضر با تشریح شرایط اعمال صلاحیت قضائی ایران ، به بررسی مبنا و ضرورت آن می پردازد.Extra-territorial Jurisdiction of Iranian Courts to Crimes of Governmental Officers and Employees
The Iranian courts are exceptionally entitled to try the offenses committed abroad by governmental officers and employees. This jurisdiction is based on the principle of personality. It sometimes also requires the respect of the principle of double criminality. Examining the conditions of the jurisdiction of iranian courts in this matter, this article tends to evaluate its foundation and necessity.
