تحلیلی بر قابلیت اعمال حقوق بین الملل بر اعمال داعش

چکیده
در سال های اخیر جامعه بین المللی شاهد ظهور گروه تروریستی موسوم به داعش یا «دولت اسلامی عراق و شام» و وحشت آفرینی آن در نقاط مختلف جهان به خصوص خاورمیانه بوده است که با اقدامات خشونت آمیز خود صلح و امنیت بین المللی را به شدت به مخاطره افکنده است. اقدامات تروریستی و جرائم بین المللی داعش، بررسی قابلیت اعمال حقوق بین الملل بر این قبیل بازیگران غیر دولتی را ایجاب می نماید. همچنین علی رغم اقدامات مختلف صورت گرفته به منظور مبارزه با داعش، تاکنون تعقیب، محاکمه و مجازات اعضای این گروه تروریستی محقق نشده است. این مقاله با بررسی حوزه های اصلی حقوق بین الملل و برخی موانع حقوقی و سیاسی نتیجه می گیرد که حقوق بین الملل موجود به نحو مطلوب به مقابله با فعالیت های داعش نمی پردازد و ناکامی جامعه بین المللی در اجرای عدالت کیفری نسبت به اعضا و رهبران داعش مؤید آن است که ایجاد یک سازوکار بین المللی جدید و همکاری بیشتر دولت ها ضرورت دارد.Analysis of the Applicability of International Law to Acts of ISIL(Da’esh)
In recent years, the international community has witnessed the emergence of a terrorist group called ISIL (Da’esh) or "Islamic State in Iraq and the Levant" and its terrorism in various parts of the world especially the Middle East, which has severely endangered international peace and security through their violent acts. The terrorist acts and international crimes of ISIL prompt an inquiry into applicability of international law to such non state actors. Also despite the various measures taken to combat ISIL, the prosecution, trial and punishment of members of this terrorist group have not been fulfilled yet. This article by examining the main areas of international law and some of the legal and political obstacles concludes that the existing international law does not adequately address the activities of ISIL, and the failure of the international community to execution of criminal justice to ISIL members and leaders reveals that a new international mechanism and more cooperation between states are needed.
