نقش دفاتر اسناد رسمی ایران در تضمین امنیت حقوقی و پیشگیری از جرایم

چکیده
امروزه، پیشگیری از دعاوی و امنیت حقوقی ضرورتی اجتناب ناپذیر است؛ و وظیفه همه ارکان حکومتی است که با شناخت جامعه و آسیبه ای پیش روی آن از طرح دعاوی جلوگیری کنند؛ بنابراین تضمین امنیت حقوقی و پیشگیری از طرح دعاوی با اهمیت ترین مسائل حقوقی هر کشوری است. تجارب نظام های حقوقی موفق در این حوزه بر نقش مؤثر دفاتر اسناد رسمی در قضازدایی و کاهش حجم ورودی پرونده های قضایی به محاکم دادگستری تأکید دارد؛ به طوری که دولت ها با برنامه ریزی دقیق و سپردن بعضی از وظایف به دفاتر، شاهد تحولاتی در خصوص نظم جامعه بوده اند. هدف از انجام پژوهش حاضر، بررسی نقش دفاتر اسناد رسمی ایران در تضمین امنیت حقوقی و پیشگیری از جرایم بود؛ که با أتخاذ رویکرد توصیفی- تحلیلی با شیوه جمع آوری اطلاعات به صورت کتابخانه ای به واکاوی این موضوع پرداخته شد؛ و این نتایج به دست آمد که دفاتر اسناد رسمی از طریق تثبیت مالکیت شهروندان بر اموال و دارایی های خود و رسمیت بخشیدن به عقود و تعهدات، ثبت الکترونیک اسناد (ثبت آنی) از انجام معاملات معارض و شکل گیری جرایمی همچون کلاهبرداری و انتقال مال غیر (در حکم کلاهبردار) جلوگیری کرده و این مسأله در تضمین امنیت حقوقی نقش دارد؛ همچنین دفاتر اسناد رسمی نقش حساسی در جلوگیری از منازعات حقوقی بی اساس و فرایند قضازدایی و برداشت حقوقی و کاهش مراجعه مردم به محاکم دادگستری و در نهایت پیشگیری از جرایم دارند.The Role of Notary Public Offices in Iran in Ensuring Legal Security and Crime Prevention
Nowadays, the prevention of lawsuits and legal security is an inevitable necessity and it is the duty of all government bodies to prevent lawsuits by knowing the society and the harms it faces. Therefore, guaranteeing legal security and preventing lawsuits are the most important legal issues in any country. The experiences of successful legal systems in this field emphasize the effective role of notaries in decriminalization and reducing the volume of incoming legal cases to the courts of justice. So that the governments have witnessed changes in the order of the society by carefully planning and entrusting some tasks to the offices. The purpose of this research was to investigate the role of notary public offices in Iran in guaranteeing legal security and preventing lawsuits, which was analyzed by adopting a descriptive-analytical approach with the method of collecting information in a library form, and these results were obtained. Public notary offices, by establishing the ownership of citizens on their property and assets and formalizing contracts and obligations, electronic registration of documents (instant registration) prevent conflict transactions and the formation of crimes such as fraud and transfer of other's property (in the case of a fraudster) and This issue plays a role in ensuring legal security. Also, notary offices play a critical role in preventing groundless legal disputes and the process of decriminalization and legal withdrawal, and reducing people's referrals to courts of law and ultimately crime prevention.
