تحلیل نظام حقوقی شرکت های دانش بنیان در پرتوی مفهوم توسعه اقتصادی (مقاله علمی وزارت علوم)

چکیده
سیاست گذاری یکی از ابزارهای مهم دخالت دولت در حوزه های مختلف از جمله حوزه اقتصادی است. امروزه، توسعه ابعاد مختلفی یافته است و توسعه اقتصادی یکی از مهم ترین ابعاد آن به شمار می رود. از سوی دیگر، در گفتمان های نوین اقتصادی، سخن از اقتصاد دانش بنیان به میان آمده است. اصطلاحی که نخستین بار، سازمان همکاری و توسعه اقتصادی آن را به کار برد و بر استفاده از دانش و فناوری در فعالیت های اقتصادی است. یکی از روش های اعمال اقتصاد دانش بنیان، استفاده از شرکت های دانش بنیان در ساختار نظام اقتصادی است. در ایران نیز در یک دهه گذشته، شرکت های دانش بنیان رشد قابل توجهی داشته اند اما این شرکت ها برای بهبود عملکرد خود نیازمند حمایت های مختلفی از سوی نهادهای حاکم می باشند. روش تحقیق در این پژوهش از نوع توصیفی-تحلیلی است و در گردآوری منابع از روش کتابخانه ای استفاده شده است. نتایج این پژوهش نشان می دهد، اعمال و کاربست سیاست های حمایتی دولت در قبال شرکت های دانش بنیان در بلند مدت، اثرات قابل توجهی بر اقتصاد دانش بنیان دارد. همچنین، شرکت های مذکور، نقش مهمی در تحقق استقلال و خودکفایی اقتصادی موضوع اصل 43 قانون اساسی ایفاء می کنند. علیرغم پیش بینی برخی حمایت های قانونی از شرکت های دانش بنیان، چالش های قانونی و اجرایی در رسیدن به نقطه مطلوب کماکان وجود دارد.Analysis of the legal system of knowledge-based companies in the light of the concept of economic development
Policy-making is one of the important means of government intervention in various fields, including the economic field. Today, development has different dimensions and economic development is one of its most important dimensions. On the other hand, in modern economic discourses, knowledge-based economy has been mentioned. A term that was used for the first time by the Economic Cooperation and Development Organization and it refers to the use of knowledge and technology in economic activities. One of the methods of applying knowledge-based economy is the use of knowledge-based companies in the structure of the economic system. In Iran, in the past decade, knowledge-based companies have grown significantly, but these companies need various supports from the governing institutions to improve their performance. The research method in this study is descriptive-analytical, and the library method was used to collect the sources. The results of this research show that the implementation of the government's support policies for knowledge-based companies in the long term has significant effects on the knowledge-based economy. Also, the mentioned companies play an important role in realizing the economic independence and self-sufficiency of Article 43 of the Constitution. Despite the provision of some legal support for knowledge-based companies, there are still legal and executive challenges in reaching the desired point.
