چکیده
تثبیت امنیت قضایی و تضمین حقوق شهروندی در گرو شناخت پدیده مجرمانه و ارائه شیوه های پسندیده و کاربردی جهت کنترل و کاهش آثار جرم است، از این رو در یک نظام حقوقی مطلوب همواره پیشگیری از وقوع جرم نسبت به برخوردهای کیفری پس از وقوع آن از اهمیت بالاتری برخوردار است، و بالطبع هرچه اهمیت و آثار ارتکاب جرمی بیشتر باشد به تناسب اهمیت پیشگیری از آن جرم نیز افزایش می یابد. امروزه جرایم علیه انفال از جمله معضلات عمده ی سیاست جنایی کشور می باشد که در عمل نیز موجب تورم پرونده ها در محاکم قضایی کشور گشته است. از یک سو، بررسی ها نشان می دهد که احتمال وقوع جرایم علیه انفال در املاکی که تثبیت نشده بیشتر است، و از سویی دیگر، وضعیت موجود ثبت اراضی ملی و املاک دولتی مطلوب نبوده و در مورد تعداد محدودی از املاک دولتی طرح کاداستر انجام گردیده است، همچنین بانک املاک جامع در این رابطه وجود ندارد و همین امر سبب گشته تا مهار کردن کلیه روش های این جرایم با مشکل جدی مواجه گردد، در نتیجه برای مقابله ریشه ای با جرایم مربوط به انفال در گام نخست می بایست مالکیت دولت را تثبیت نمود. طرح کاداستر با قابلیت ترسیم اراضی و املاک تحت مالکیت خصوصی اشخاص، تثبیت میزان منابع طبیعی کشور و همچنین اندازه گیری اراضی مورد وقف، نقش بسزایی در پیشگیری از جرایم علیه انفال ایفا می کند، چرا که استخراج چنین اطلاعاتی موجب مدیریت بهتر در عرصه اقتصاد کشور و بهینه سازی در برنامه ریزی ها ، سیاست گذاری های کلان مدیریت و نظارت بهتر بر دارایی های غیرمنقول کشور خواهد شد. بر همین اساس و با توجه به تجربیات عملی ، نوشتار پیش رو به کارکردهای پیشگیرانه طرح کاداستر در جرایم علیه انفال می پردازدThe role of the cadastre in preventing crimes against Public properties( Anfal)

It is higher, and of course, the greater the importance and effects of a crime, the greater the importance of preventing that crime. Today, crimes against Public properties( Anfal) ) are among the major problems of the country's criminal policy, which in practice has caused the inflation of cases in the country's courts. On the one hand, studies show that crimes against Public properties( Anfal) are more likely to occur on unregistered properties, and on the other hand, the current state of registration of national lands and state properties is not favorable and a cadastral plan has been implemented for a limited number of state properties. There is also no comprehensive real estate bank in this regard, and this has led to serious problems in curbing all methods of these crimes, so in order to tackle the Public properties( Anfal) ) -related crimes in the first place, government ownership must be established. The cadastral plan with the ability to map privately owned lands and properties, stabilize the country's natural resources and also measure endowed lands, plays an important role in preventing crimes against Public properties( Anfal) , because the extraction of such information leads to better management of the country's economy. And optimization in planning, macro policies, management and better monitoring of the country's real estate. Accordingly, and with regard to practical experience, the present article deals with the preventive functions of the cadastral plan in crimes against Public properties( Anfal)
