چکیده
در 9 ژوئیه 2004 دیوان بین المللی دادگستری، مبادرت به نظر مشورتی در خصوص ساخت دیوار حائل در اراضی اشغالی فلسطین کرد. دیوان، با استناد به کنوانسیون های حقوق بشردوستانه و حقوق بشری، ساخت دیوار حائل را غیرمشروع اعلام کرد. به رغم آنکه نظریه مشورتی دیوان ناظر بر غیرمشروع بودن ساخت دیوار حائل بود، اما رژیم اشغالگر از آن سال تاکنون، اقدام به ساخت چند دیوار دیگر ازجمله ساخت دیوار حائل در غزه کرده است. با توجه به نقض قواعد بنیادین حقوق بشردوستانه بین المللی و حقوق بشر در سطحی بسیار گسترده توسط رژیم اسرائیل در مخاصمه غزه پس از 7 اکتبر 2023، بازخوانی مجدد رأی دیوان مهم است. هدف این نوشتار، بررسی ابعاد حقوق بشردوستانه و حقوق بشری نظریه مشورتی دیوان است. براین اساس، با تأکید بر وضعیت نوار غزه به مثابه سرزمینی اشغالی و نقض قواعد حقوق اشغال به واسطه ارتکاب جنایات گسترده توسط رژیم اشغالگر اسرائیل در مخاصمه 2023- 2024 در غزه، توجه به تبعات منفی روانی و انسانی ساخت دیوار حائل در غزه که به دلیل نقض حقوق بشر روی داده و در حمله حماس به مواضع اسرائیل مؤثر بوده، دارای اهمیت است.Rereading the advisory opinion of the ICJ in the construction of a wall, considering the Zionist regime crimes after October 2023 in Gaza
On July 9, 2004, the International Court of Justice issued an advisory opinion concerning the construction of a wall in the occupied Palestinian territories. The court by determining the rules and principles of International law rendered its advisory opinion the construction of the wall is illegal. Although, Israel was under an obligation to terminate its breaches of international law, the Israeli occupation regime started to construct several more walls, including the construction of the wall in Gaza. Therefore, Considering the violation of the fundamental rules of international humanitarian law and human rights on a very wide level by the Israeli regime in the Gaza conflict after October 7, 2023, it is important to reread the advisory opinion of the court. The purpose of this article is to examine the dimensions of humanitarian rights and human rights in the advisory opinion of ICJ. Hence, by emphasizing the status of the Gaza Strip as an occupied territory and the violation of the rules of occupation due to the large-scale crimes committed by the occupying regime of Israel in the 2023- 2024 conflict in Gaza, it is of paramount importance to regard the negative psychological and human consequences of the construction of the wall in Gaza caused by the violation of human rights in this region. For this issue has been effective in the attack of Hamas on Israeli positions.
