چکیده
اصطلاحات سازمان وابسته به دولت، شرکت وابسته به دولت، و مؤسسات وابسته به دولت در قانون اساسی و قوانین عادی استفاده شده و برای آن ها تعریف شفاف و مستقلی ارائه نشده است. این ابهام (عدم شفافیت) صدورِ آرای قضایی ناصواب (که مد نظر مقنن نبوده است) در تفسیر قوانین یادشده را ایجاد کرده است. سؤال نوشتار پیش رو این است که قانون گذار و قضات محاکم دادگستری باید چه مفهومی از این اشخاص را مد نظر قرار دهند. برای پاسخ به این پرسش، با روش تحلیلی انتقادی، قانون اساسی و رویه شورای نگهبان و قوانین عادی مطالعه می شود و در نهایت، با بررسی موردی شرکت های توزیع برق، ضوابط تعریف اشخاص وابسته به دولت ارائه می شود. این شرکت ها نماد اشخاص وابسته به دولت اند. یافته های تحقیق نشان می دهد منظور مقنن از شخص وابسته به دولت شخصی است که تحت کنترل مدیریتی دولت (به معنای عام آن) قرار دارد و لازم نیست مالکیت یا سرمایه شخص وابسته متعلق به دولت باشد. بر این اساس لازم است مراجع قضایی و مقامات اجرایی در تفاسیر خود از قوانین این برداشت را ملاک عمل قرار دهند. پیشنهاد می شود این اصطلاح در قانون بر اساس ضوابط اشاره شده تعریف شود تا از تشتت تفاسیر اجرایی و قضایی پیشگیری شود.“Organizations, Companies, Institutions Affiliated to the Government” Legal Analyze: the Case Study on the Electricity Distribution Companies
The terms “organizations, companies, institutions affiliated to the government” are used in the constitution and ordinary laws, and no clear and independent definition has been provided for it, so this ambiguity (lack of transparency) has caused the issuance of incorrect judicial decisions (which were not intended by the legislator) in the interpretation of the aforementioned laws. The question of the paper is what concept of these people should be taken into consideration by the legislator and the judges of the courts of law. In order to answer this question, the constitution, the procedure of the Guardian Council and ordinary laws are studied with an analytical-critical method, and finally, with the case study of electricity distribution companies, the criteria for defining government-affiliated persons are presented. The electricity distribution companies are the big symbol of entities affiliated to the government. This paper shows the intention of constitution (and so, intention of legislation) to use the term is any person be controlled by government (in its wide meaning); it doesn’t require to be owned by government. So, it is neccesary to be chosen this interpretation of rules by judiciary and executive officials.
