چکیده
امروزه در پذیرش جرایم امنیتی سایبری به عنوان نوع جدیدی از جرایم سایبری کمتر تردیدی وجود ندارد.با وجود این،دیدگاه ها و نظریات در مورد شناخت محدوده و ملاک جرایم امنیتی سایبری متنوع و متفاوت است،بر اساس این ضرورت و به دلیل اهمیتی که فضای سایبر در بعد فرصت ها و تهدیدات دارد و نقش برجسته قدرت سایبری در جایگاه کشورها در سلسله مراتب قدرت جهانی،چالش اساسی این است که شناخت محدوده و ملاک جرایم امنیتی سایبری کدام است که موجب اختلاف نظر گردیده است،به طوری که تقسیم بندی های مختلفی از انواع و مصادیق جرایم امنیتی ارائه شده است.پژوهش حاضر با هدف،شناخت محدوده و ملاک جرایم امنیتی سایبری صورت گرفته است که از لحاظ هدف کاربردی و از نظر ماهیت،توصیفی-تحلیلی است.همچنین به بررسی موارد مشابه که در سایر قوانین نیز بیان شده و امکان ارتکاب آن وجود دارد پرداخته شده از جمله قانون مجازات جرایم نیروهای مسلح که آیین رسیدگی به این جرایم نیز مورد بررسی قرار گرفته است.روش جمع آوری اطلاعات به شیوه کتابخانه ای از کتب معتبر و با ابزار فیش برداری بوده است.یافته ها نشان داد برای شناخت جامع و دقیق جرایم امنیتی سایبری باید از رهیافت تلفیقی-تطبیقی استفاده شود و چارچوبی مبتنی بر نگاه بین رشته ای و تلفیق همه رویکردها را مدنظر قرار داد.بر همین اساس،چارچوب تحلیلی بدیلی مبتنی بر پیوند این رویکردها ارائه شده است.Scope and criteria for recognizing cyber security crimes

It has been stated and it is possible to commit it, including the Law on Punishment of Crimes of the Armed Forces, which has also examined the procedure for investigating these crimes. Showed that for a comprehensive and accurate understanding of cyber security crimes should be intercepted An adaptive-comparative finding was used and a framework based on interdisciplinary perspective and integration of all approaches was considered. Accordingly, an alternative analytical framework based on the linkage of these approaches is presented.
