چکیده
سَبُّ النبی هو أحد مواضیع الفقه الجنائی الإسلامی وهو أمر مهم للغایه والعدید من الآیات والأحادیث تشیر إلیه. نظرًا لأنه فی الفقه الجنائی الإسلامی ، یتم توفیر عقوبه خاصه لهذا العنوان. لذلک یمکن أن یکون حجه لمعارضین هذا الحکم. إذن، ما هی خطه هذا الموضوع او سَبّ النبی؟ ومن هو سَابّ النبی؟ وما هی حالته له أهمیه خاصه. بالإضافه إلى ذلک ، فإن الأسس الشرعیه لحرمه سبى النبی هی الروایات المتواتره المذکوره فی الفقه الإسلامی. فی الفقه الجنائی الإسلامی ، نطاق هذا الحکم إنتشرالی حالات مثل إهانه مقدسات الإسلام و کل من الأنبیاء العظام وأئمه الطاهرین وحضره فاطمه الزهراء (ع). اعتبرت جمیع المذاهب الإسلامیه وکل فقهاء فرقین سب النبی من الجرائم التی یعاقب علیها بالإعدام. مع اختلاف أنه لا یوجد باب مستقل تحت عنوان ساب النبی فی کتب الفقه السنی. لذلک ، یتم فحص هذه المسأله فی إطار موضوع الرده. لذلک ، فی هذا المقال ، سیر عمل النظام القانونی-الفقهی الإیرانی بالنسبه لجریمه ساب النبی ، سیتم دراستها بالطرق التحلیلیه والوصفیه والمکتبه. الکلمات الرئیسیه: الفقه الجزائی، القانون الجنائی، سب النبی، سَابّ النبی، الفقه الشیعی، فقه السنه.A literary comparative study of the jurisprudential documents of the ruling of cursing the Prophet based on the opinions of the two teams
Sab-ul-Nabi is one of the topics of Islamic penal jurisprudence, which is very important and many verses and traditions refer to it. Since in Islamic penal jurisprudence, a special punishment is provided for this title. Therefore, it can be used as an argument for the opponents of this ruling. So, what is the plan of this topic, Sab-ul-Nabi? And who is Subal-Nabi? And what is its condition is of special importance. All Islamic schools of thought and all jurists of Fariqin have considered Sab-ul-Nabi as one of the crimes punishable by death. With this difference, there is no independent chapter under the title Sab-ul-Nabi in the jurisprudence books of Ahl al-Sunnah, so they examine this issue under the topic of apostasy. Therefore, in this article, the reaction of Iran's jurisprudential-legal system will be studied with analytical, descriptive and library methods.
