چکیده
«رویکردهای متفاوت نسلی» (از توافق میان نسل ها تا گسست و فروپاشی بین نسلی) در شاخه «جامعه شناسی نسلی» مطالعه و بررسی می شود. در حقوق و علوم سیاسی نیز «اعتباربخشی یا اعتبارزدایی از قانون و نظام سیاسی حقوقی» در قالب دامنه ای از نظرها و اندیشه ها مطرح شده است. در تبیین رابطه و پیوند میان این دو حوزه، این سؤال قابل طرح خواهد بود که رویکردهای متفاوت نسلی در نظام جمهوری اسلامی ایران، چه نوع رابطه ای با فرایند اعتبار بخشی یا اعتبارزدایی از قانون اساسی موجود دارند؟ در حقیقت چنانچه داده های جامعه شناسی نسلی بر وقوع گسست نسلی در ایران صحه گذارد، آیا می توان با استناد به حق تعیین سرنوشت در حقوق، به اعتبارسنجی مجدد قانون اساسی موجود اقدام کرد؟ مقاله پیش رو با مطالعه ای میان رشته ای و به روش توصیفی- تحلیلی به بررسی این ارتباط پرداخته است. استفاده و استناد کردن به ابژه های فرانسلی در جامعه شناسی در کنار ادله پیشا قانون اساسی از سویی و فرا قانون اساسی از سوی دیگر، تبیین کننده وجود رابطه تباین میان این دو مقوله شده است.The Role of Generational Approaches in the Validity of the Constitution of the Islamic Republic of Iran
Different generational approaches (from intergenerational agreement to intergenerational rupture and collapse) are studied and analyzed in "generational sociology". In law and political science, crediting or discrediting the law and legal political system has been proposed in the form of a range of opinions and ideas. In explaining the relationship between these two areas, the question arises, how different generational approaches relate to the process of validating or invalidating the existing Iranian constitutional order? In fact, if generational sociological data confirms the occurrence of a generation gap in Iran, is it possible to revalidate the existing constitution by citing the legal right to self-determination? The following article has examined this relationship as an interdisciplinary study and with a descriptive analytical method. Using trans- generational objects in sociology and pre-constitutional arguments on the one hand and extra-constitutional reasoning on the other, the paper explains the existence of a conflicting relationship between these two categories.
