نگاهی به گستره مقاومت و حدود عقبنشینی از منظر فقه سیاسی

چکیده
نظریه مقاومت و استکبارستیزی پس از پیروزی انقلاب اسلامی و با توجه به آرمان های نظام جدید به عنوان یکی از شعارات اساسی برجسته شد. از همین رو سخنان بسیار و اظهارنظرهای ضدونقیضی در این باره، از سوی گرایش های مختلف سیاسی و اجتماعی مطرح شد. در این نوشتار با بهره گیری از مبنای «فقه النظریه» که در راستای دستیابی به زیربناهای نظامات فقهی به استنباط می پردازد، حدود و ثغور مقاومت و عقب نشینی مورد بررسی قرار گرفته است. به همین جهت و در راستای رسیدن به زیربنا و نظریه فقه مقاومت، آیات 15 و 16 سوره انفال به مثابه مبنای حکم کلی فرار از جنگ بررسی شده است. در این مقاله، ابتدا مدلول آیات مذکور در تقاسیر شیعه و اهل سنت بررسی و سپس قول به نسخ آین آیات رد می شود. آیات معارض بررسی و سپس حدود مقاومت در این آیات تعیین می شود و با ادله عقلی نقدهایی بر روایات اهل سنت ذیل آیات مذکور طرح می شود. با استناد به تراث فقهی و فتاوی فقها و همچنین آیه 45 سوره انفال، یک حکم فقهی کلی استخراج و در ادامه به مثابه یک قاعده فقهی اصطیادی، امکان سنجی می شود. ازآنجاکه امروزه مقاومت امری است فراتر از مرزهای ایران و حتی فراتر از مذهب شیعه، در پژوهش حاضر سعی شده است بیشترین تمرکز روی ادله قرآنی باشد تا از حیث حجیت ادله، منحصر به یک مذهب نبوده و کاری در تراز امت اسلام باشد.A Look at the Expanse of Resistance and Scope of Retreat from Political Fiqh Perspective
One of the major mottos on which the Islamic Revolution is based is resistance and fighting istikbar (world arrogance). This has given rise to contradictory remarks on the part of different social and political groups. The article has a recourse to theoretical fiqh which aims at deducing the foundations of fiqh -based systems in order to survey the limitations of resistance and retreat. The two holy Quranic verses 15 and 16 from surah al-Anfal have been taken as the basis for the conditions that lead to leaving the battlefield. First, the implications of the ayas are examined from both shiite and sunni points of view and any abrogation ( naskh ) of them is rejected. Other seemingly contradictory ayas have also been taken into notice that could lead us to the limitations of resistance and some criticism of sunni interpretation of them have been offered. Finally, a general rule has been extracted by taking as evidence some fatwas , aya 45 of surah al-Anfal , and since resistance today has extended beyond Iranian borders and even shiite communities, this research has concentrated on Quranic evidence to ensure its reliability and not to limit it to any Islamic school of thought.
