بررسی حقوقی ورود نیروهای مسلح در شرایط اضطراری ناشی از شیوع کرونا

چکیده
دولت ها در شرایط اضطراری از تمام ظرفیت های موجود، برای عبور از بحران ایجاده استفاده می نمایند. با حاکم شدن شرایط اضطراری ناشی از شیوع ویروس کرونا در اغلب کشورها، دولت ها سعی کردند از ظرفیت نیروهای مسلح در مقابله با این ویروس استفاده نمایند. نیروهای مسلح در زمان صلح، به دلیل داشتن امکانات و توان استفاده از اقتدارات ویژه ازجمله واکنش سریع به بحران ها از طرق مهندسی و فناورانه و همچنین اعمال زور، مورد توجه دولت ها برای عبور از حالت اضطراری می باشد. برای ورود نیروهای مسلح در مسائل غیرنظامی، قواعد و مقررات خاصی در کشورها برای جلوگیری از سوء استفاده از قدرت وجود دارد و این ورود باید تحت قواعد حقوقی قرار گیرد. در ایران برای مقابله با بحران ناشی از شیوع ویروس کرونا، نیروهای مسلح ورود پیدا کردند. لذا این سؤال به وجود می آید که «ابعاد حضور نیروهای نظامی در شرایط اضطراری به ویژه در موضوع کرونا ویروس در ایران چیست؟» برای پاسخ به این پرسش با روش توصیفی تحلیلی به بررسی منابع حقوق ایران پرداخته شد. در پی شیوع ویروس کرونا، کشور در شرایط اضطراری قرار گرفته است و ضمن اینکه دولت مکلف است از توان نیروهای نظامی برای عبور از بحران استفاده نماید، برای ورود نیروهای مسلح قواعدی وجود دارد که مورد بررسی و تجارب سایر کشورها در این حوزه بیان شده است.Legal review of the entry of armed forces in emergencies due to the outbreak of coronavirus
In emergencies, governments use all available capacities to get through the crisis. As emergencies caused by the coronavirus outbreak prevailed in most countries, governments tried to use the armed forces' capacity to fight the virus. In peacetime, the armed forces are of interest to governments in passing through a state of emergency due to their ability to use force. For the entry of the armed forces in civilian matters, there are certain rules and regulations in countries to prevent abuse of power, and this entry must be subject to the rules. In Iran, armed forces arrived to deal with the crisis caused by the coronavirus outbreak. Therefore, the question arises as to what are the dimensions of the presence of military forces in emergencies in Iran? In order to answer this question, iran's rights resources were investigated using descriptive-analytical method. In the wake of the coronavirus outbreak, the country is in a state of emergency, and while the government is obliged to use the military force's ability to get through the crisis, there are rules for the entry of the armed forces, which have been discussed and the experiences of other countries in this area.
