Modern International Law in the Light of USA Unilateralism
Great powers with different capabilities have a privileged position to operate in various international arenas. One of these cases is the role they play in creating international legal rules. In the modern era, which includes the period after 1945, great powers have formed new legal rules in addition to development of traditional international law through their cooperation and competition. the unilateralism of great powers can also have many effects on international law. The purpose is to investigate the unilateralism of the America in the field of international relations and its effects on international law. the question is, how does America's unilateralism in the field of international relations affect international law? the hypothesis is due to the fact that America, as the hegemon, has the capacity to influence the field of international relations, In the field of international law, the unilateralist action of this country, although it can lead to the creation of international customs in some cases, but in practice, it causes weakness and functional crisis in this area. The results show that the unilateral action of America in preemptive defense, use of drones, and use of torture to obtain confessions from terrorist suspects leads to ignoring general rules and ultimately weakening international law. The current study has analyzed the unilateralism of the America in the field of international law with a descriptive-analytical approach in the three areas of creating international custom, the cross-border consequences of domestic law, and the interpretation of the rules of international law by this country.

چکیده
قدرت های بزرگ با توانمندی هایی مختلف، موقعیت ممتازی برای فعالیت در عرصه های گوناگون بین المللی دارند. یکی از این موارد نقشی است که در زمینه ایجاد قواعد حقوقی بین المللی دارند. در دوره مدرن که دوره زمانی بعد از 1945 را در بر می گیرد، قدرت های بزرگ با همکاری و رقابت خود علاوه بر توسعه حقوق بین الملل سنتی، در بسیاری از موارد به قواعد حقوقی جدیدی نیز شکل داده اند. علاوه بر همکاری و رقابت، یکجانبه گرایی قدرت های بزرگ نیز می تواند آثار زیادی بر حقوق بین الملل داشته باشد. هدف پژوهش حاضر بررسی یکجانبه گرایی امریکا در عرصه روابط بین الملل و تأثیرات آن بر حقوق بین الملل است. بدین لحاظ سؤال این است یکجانبه گرایی آمریکا در عرصه روابط بین الملل چگونه حقوق بین الملل را تحت تأثیر قرار می دهد؟ در فرضیه می توان گفت با توجه به اینکه امریکا به عنوان هژمون، ظرفیت تأثیرگذاری بالایی بر عرصه روابط بین الملل دارد، در حوزه حقوق بین المللی نیز عملکرد یکجانبه گرایانه این کشور اگرچه می تواند در مواردی منجر به ایجاد عرف بین المللی شود، ولی در عمل موجبات ضعف و بحران کارکردی این حوزه را فراهم می کند. نتایج پژوهش نشان می دهد که عملکرد یکجانبه امریکا در مواردی مانند دفاع پیشدستانه، استفاده از پهپادها و استفاده از شکنجه برای گرفتن اقرار از متهمین تروریستی منجر به نادیده گرفتن قواعد عمومی و در نهایت تضعیف حقوق بین الملل می شود. پژوهش حاضر با رویکرد توصیفی-تحلیلی یکجانبه گرایی امریکا در عرصه حقوق بین الملل را در سه حوزه ایجاد عرف بین المللی، پیامدهای فرامرزی حقوق داخلی و تفسیر قواعد حقوق بین المللی توسط این کشور مورد بررسی قرار داده است.تبلیغات
