چکیده
در نظام حقوقی ایران برمبنای نظریه خطر و با وضع قانون بیمه اجباری وسایل نقلیه موتوری مصوب 1347، دارندگان این گونه وسایل در قبال زیان دیدگان حوادث رانندگی مسئولیت مدنی یافتند و به تبع آن مکلف به اخذ بیمه نامه شدند لیکن با اصلاحات همراه با تناقض و ابهام سال 1387، در این نوع از مسئولیت مدنی، تزلزل و تشکیک ایجاد شد و نهایتاً با تصویب قانون بیمه اجباری مصوب 1395 تردیدها زدوده شد و قانونگذار نوع خاصی از مسئولیت کیفری را جایگزین مسئولیت مدنی سابق کرد به این صورت که ابتدائاً ایشان را مکلف به اخذ بیمه نامه نمود و ضمانت اجرای اصلی این تکلیف را صرفاً پرداخت جزای نقدی به صندوق جبران خسارت های بدنی مقرّر کرد. نفی مسئولیت مدنی از دارندگان وسایل نقلیه و جایگزین نمودن مسئولیت کیفری در قبال آن به معنای افول نظریه خطر در نظام حقوق مسئولیت مدنی ایران و در راستای مشروعیت بخشی به قوانین مستحدثه نیز می باشد. در این تحقیق با تأکید بر نوآوری های قانون بیمه اجباری 1395 به سیر تحولات مسئولیت دارندگان وسایل نقلیه و تحلیل دیدگاه های مختلف پرداخته می شود.Liability of Vehicle Owners against Third Parties such as Civil or Criminal Liability? “Theory of Risk in the Law of Iran from Appearance till Wane and the Evolution of Responsibility of Vehicle Owners”
Based on the theory of risk and legislated compulsory insurance of motor vehicles approved in 1347, holders of these devices on the civil liability losses were victims of traffic accidents but the reforms with contradictions and ambiguities in 1387, in this type of civil liability, insecurity and doubt was created. And finally, with the adoption of mandatory insurance law passed by the legislature in 1395 doubts had been dispelled and a certain type of criminal responsibility was replaced by former civil liability. Denial of civil liability of owners of vehicles mean the decline of the theory of risk in Iranian legal system. In this study, with an emphasis on innovation, mandatory insurance law in 1395 to analyze developments liability of owners of vehicles and different perspectives will be discussed.
