چکیده
پژوهش حاضر به بررسی نقش بزه دیده در تحقق یا انقطاع استناد جنایت می پردازد. در حقوق کیفری اسلامی، مسئولیت جزایی و مدنی زمانی تحقق می یابد که میان رفتار مرتکب و نتیجه زیان بار، رابطه ای عرفی و عقلایی برقرار باشد. با این حال، رفتار بزه دیده نیز می تواند در وقوع یا تشدید جنایت نقش آفرین باشد و موجب قطع یا تضعیف رابطه استناد گردد. این پژوهش با روش توصیفی - تحلیلی و بر پایه منابع اصیل فقه امامیه، حقوق موضوعه و قانون مجازات اسلامی ۱۳۹۲ سامان یافته است. یافته ها نشان می دهد هرگاه رفتار بزه دیده ارادی، آگاهانه و مستقل باشد، می تواند رابطه استناد را قطع کند و مسئولیت کیفری مرتکب رفع شود. ماده ۵۳۷ قانون مجازات اسلامی نیز مؤید پذیرش این قاعده است، هرچند در گستره ضمان همچنان ابهاماتی وجود دارد. نوآوری این پژوهش در تمرکز ویژه بر جایگاه بزه دیده در فرایند استناد جنایت و ارائه الگویی برای توزیع منصفانه مسئولیت کیفری است.A Juridical and Legal Examination of the Victim's Role in Attributing Criminality
The present study undertakes an analysis of the victim's role in the realization or the severing of the link of criminal attribution. In Islamic penal law, both criminal and civil liability are established only when an ordinary and rational causal relationship is present between the perpetrator's conduct and the harmful outcome. Nevertheless, the victim's own behavior can also play a pivotal role in the commission or aggravation of the crime, thereby leading to the interruption or weakening of that very causal link. This research employs a descriptive-analytical methodology and is founded upon the authentic sources of Imami jurisprudence, statutory law (lex scripta), and the Islamic Penal Code of 2013. Findings indicate that whenever the victim's conduct is volitional, cognizant, and independent, it possesses the capacity to sever the link of attribution, thus lifting the criminal responsibility from the perpetrator. Article 537 of the Islamic Penal Code further corroborates the acceptance of this principle, even though ambiguities still persist concerning the full extent of the compensatory liability (daman). The novelty of this research lies in its specific focus on the victim's position within the process of criminal attribution and in offering a model for the equitable distribution of criminal responsibility.
